Common use of Design and supply of Equipment Clause in Contracts

Design and supply of Equipment. Details of the design of Equipment is shared with the Service Manager, not necessarily for his acceptance but, as an assurance that the Equipment will be able to allow the Contractor to Provide the Service efficiently and without delay. Also the Employer may wish to exercise constraints or include witness and hold points during manufacture, assembly or delivery of such Equipment. The Contractor submits particulars of the design of an item of equipment to the Service Manager for acceptance when the Service Manager instructs him to. A reason for not accepting is that the design of the item will not allow the Contractor to provide the service in accordance with the Service Information, accepted plan or the applicable law.
