Equipment and Materials. Contractor at its sole cost and expense shall provide and furnish all tools, labor, materials, equipment, transportation services and any other items (collectively, "Equipment") which are required or necessary to perform the Services in a manner which is consistent with generally accepted standards of the profession for similar services. Notwithstanding the foregoing, District shall not be responsible for any damages to persons or property as a result of the use, misuse or failure of any Equipment used by Contractor of the Contracted Parties, even if such Equipment is furnished, rented or loaned to Contractor or the Contracted Parties by District. Furthermore, any Equipment or workmanship that does not conform to the regulations of this Agreement may be rejected by District and in such case must be promptly remedied or replaced by Contractor at no additional cost to District and subject to District’s reasonable satisfaction.

Equipment and Materials. Except as otherwise specified in this Agreement, the Supplier shall provide all equipment and materials reasonably necessary for the provision of the Services. Any equipment used in the provision of the Services and belonging to the Company, which is damaged, lost or unduly worn due to negligence, misuse, or wilful action by the Supplier or its employees or other persons for whose action it is responsible, must be replaced at the Supplier’s own expense.

The Contractor shall ensure that all equipment used in connection with the Contract is maintained in good working order in compliance with manufacturer’s instructions and current legislation. All equipment and materials used by the Contractor shall comply with latest relevant British Standard or European equivalent specifications where such exist and the Contractor shall upon request furnish the Authorised Officer with evidence to prove that such equipment and materials comply with this condition. The Contractor shall: establish effective planned maintenance programmes; and make adequate arrangements for emergency remedial maintenance, to ensure continuity of the Services; and agree all equipment purchases with the Authority; and ensure compliance with all regulations covering the inspection and testing of all equipment used at the Location in the provision of the Services; and maintain records, open for inspection by the Authority of maintenance testing and certification. Any communication or electrical equipment used by the Contractor in connection with the Contract shall not cause any interference with or damage to any equipment used by the Authority or any Beneficiary. Any communication or electrical equipment proposed to be used by the Contractor in connection with the Contract shall, at the discretion of the Authority be tested and approved by the Authority before use on the Authority’s or any Beneficiary’s premises. Equipment and Materials if any furnished by the Trust Equipment and materials if any made available to the Service Provider by the Trust shall be the property of the Trust and shall be marked accordingly. Upon termination or expiration of this Contract, the Service Provider shall make available to the Trust an inventory of such equipment and materials and shall dispose of such equipment and materials in accordance with the Trust’s instructions. While in possession of such equipment and materials, the Service Provider unless otherwise instructed by the Trust in writing, shall insure them at the expense of the Service Provider in an amount equal to their full replacement value.

Contractor shall provide sufficient qualified supervision, labor, proper materials, supplies, and equipment, including personal protective equipment, and all other necessary and incidental items and components. Contractor shall perform staging, hoisting, handling, unloading and loading of equipment and any materials. Contractor shall complete Landscaping Services in a professional and safe manner, using quality equipment and materials that conform to all Federal, State and local regulations. All equipment must be commercial grade and of sufficient size to complete tasks effectively and in a timely manner. All equipment must meet Occupational Safety and Health Administration (“OSHA”) standards and be in good working order capable of being used as originally intended. Contractor shall be responsible for routine maintenance repairs and damage to equipment and materials.
