DCWR. (other than "CARCO Certificate") in the Amended and Restated Pooling and Servicing Agreement, the Related Documents and the Trust Documents shall refer to the Designated Affiliate. Except as expressly amended hereby, all of the representations, warranties, terms, covenants and conditions of the Amended and Restated Pooling and Servicing Agreement, the Related Documents and the Trust Documents applicable to DCWR shall remain unamended and shall continue to be, and shall remain, in full force and effect in accordance with their terms and, except as expressly provided herein, the execution and delivery of this Agreement by the Trustee shall not constitute or be deemed to constitute a waiver of compliance with or a consent to non-compliance with any term or provision of the Amended and Restated Pooling and Servicing Agreement, the Related Documents and the Trust Documents.
