CONSIDER THE IMPACTS. OF THE PROPOSED PROJECT, EVEN IF TEMPORARY. Describe planned efforts during and after construction to: • Minimize erosion, sedimentation, or turbidity? On all sites, the work will be completed during low flow or no-flow period. Temporary erosion control measures would be installed as needed to minimize the potential for sediment delivery. All disturbed areas will be seeded immediately after completion. • Minimize stream channel alterations? Site 1: Xxxxxx Spur station 21+33 slash filters will be placed along the toe of the fill at the CMP crossing site. Site 2: Wetland Spur station 34+15 rock armoring will be placed at the inlet and outlet. Site 3: Cilly Creek Rd. MP 1.43… existing CMP will be replaced with a larger diameter CMP which will be placed in the same location. • Minimize effects to stream flow or water quality caused by materials used or removal of ground cover? Ground covering vegetation removal will be minimized as much as feasible. Area will be grass seeded and have erosion control measures installed as needed (slash filter, silt fence or wattles) to help minimize erosion, and sediment delivery to the stream. • Minimize effects on fish and aquatic habitat? Activities will be done during low flow or no flow period; duration of activities will be minimized. • Minimize risks of flooding or erosion problems upstream and downstream? Crossing structures are properly sized to minimize the potential for flooding. • Revegetate/protect existing vegetation and control weeds? Area will be grass seeded on the disturbed area to help minimize erosion and reduce to available space for weeds. All seed will be certified noxious weed free (blue tagged).

  • IDENTIFYING THE PROBLEM During the early stages of problem detection, the NMC will be able to tell which CLECs are affected by the catastrophe. Further analysis and/or first hand observation will determine if the disaster has affected CLEC equipment only, BellSouth equipment only or a combination. The initial restoration activity will be largely determined by the equipment that is affected. Once the nature of the disaster is determined and after verifying the cause of the problem, the NMC will initiate reroutes and/or transfers that are jointly agreed upon by the affected CLECs' Network Management Center and the BellSouth NMC. The type and percentage of controls used will depend upon available network capacity. Controls necessary to stabilize the situation will be invoked and the NMC will attempt to re-establish as much traffic as possible. For long-term outages, recovery efforts will be coordinated by the ECC. Traffic controls will continue to be applied by the NMC until facilities are re-established. As equipment is made available for service, the ECC will instruct the NMC to begin removing the controls and allow traffic to resume.

  • THE ACADEMY 2.1 The Company will establish and maintain, and carry on or provide for the carrying on of the Academy in accordance with the Master Agreement and this Agreement.

  • SUSPENSIVE CONDITIONS 18.1 The Contract is subject to the suspensive condition that the Purchaser obtains a loan in the amount reflected in clause 7 of the SCHEDULE, forming part of the Purchase price payable by the Purchaser to the Seller for the Property, from a bank or other financial institution, against the security of a first mortgage bond over the Property in favour of such bank or financial institution, such loan to be approved in writing by such bank or financial institution within the period stipulated in clause 9 of the SCHEDULE.

  • SUSPENSIVE CONDITION i) The contract only becomes binding and enforceable once:

  • ROAD GRADE AND ALIGNMENT STANDARDS Purchaser shall follow these standards for road grade and alignment except as designed:  Grade and alignment must have smooth continuity, without abrupt changes in direction.  Maximum grades may not exceed 18 percent favorable and 12 percent adverse.  Minimum curve radius is 60 feet at centerline.  Maximum grade change for sag vertical curves is 5% in 100 feet.  Maximum grade change for crest vertical curves is 4% in 100 feet.

  • Fire Hazards Explosives and inflammable materials which conflict with the Insurance Underwriting or Fire Department must be excluded. The City Fire Department prohibits the use of paper, crepe paper, or corrugated papers, and cardboard that has not been flame proofed for decoration of exhibit booths. All cloth drapes or table covers must be treated for fire resistance. All boats and motorized vehicles must have fuel tanks sealed and batteries disconnected. The Fire Marshal may require fuel tanks to be drained and purged. All exhibits must be in compliance with ordinances and laws of the City and the State in which the Show is held.

  • Aggravating and Mitigating Factors The penalties in this matter were determined in consideration of all relevant circumstances, including statutory factors as described in CARB’s Enforcement Policy. CARB considered whether the violator came into compliance quickly and cooperated with the investigation; the extent of harm to public health, safety and welfare; nature and persistence of the violation, including the magnitude of the excess emissions; compliance history; preventative efforts taken; innovative nature and the magnitude of the effort required to comply, and the accuracy, reproducibility, and repeatability of the available test methods; efforts to attain, or provide for, compliance prior to violation; action taken to mitigate the violation; financial burden to the violator; and voluntary disclosure. The penalties are set at levels sufficient to deter violations, to remove any economic benefit or unfair advantage from noncompliance, to obtain swift compliance, and the potential costs, risks, and uncertainty associated with litigation. Penalties in future cases might be smaller or larger depending on the unique circumstances of the case.

  • New Member Orientation The Employer will notify the Union of any newly represented temporary employees. The Union will be given the opportunity to have a Union representative speak with the newly represented temporary employees for not more than thirty (30) minutes to provide information about the Union and this Agreement.

  • Procurement Standards For projects being managed by the Local Government and on the State highway system or that include state funding, the Local Government must obtain approval from the State for its proposed procurement procedure for the selection of a professional services provider, a contractor for a construction or maintenance project, or a materials provider.
