Changes; Waiver. No change or modification of this Agreement shall be valid unless the same is in writing and signed by all parties hereto. No waiver of any provision of this Agreement shall be valid unless in writing and signed by the person against whom it is sought to be enforced. The failure of any party at any time to insist upon strict performance of any condition, promise, agreement, or understanding set forth herein shall not be construed as a waiver or relinquishment of the right to insist upon strict performance of the same or any other condition, promise, agreement, or understanding at a future time.

Changes; Waiver. We reserve the right to change, delete or add to this Agreement and to apply any such modification to a Wal-Mart Prepaid Card that has been issued to you and to value on your Wal-Mart Prepaid Card. We will provide you notice of any such modification as required by applicable law. If we decide not to enforce our rights or charge a fee in one situation, we are not giving up our right to enforce it or to charge the fee in a later situation.
