Business Associate’s Subcontractors and Agents. BA shall ensure that any agents and subcontractors that create, receive, maintain or transmit Protected Information on behalf of BA, agree in writing to the same restrictions and conditions that apply to BA with respect to such Protected Information and implement the safeguards required by paragraph 3.4 above with respect to Electronic PHI [45 C.F.R. Section 164.504(e)(2)(ii)(D); 45 C.F.R. Section 164.308(b)] BA shall implement and maintain sanctions against agents and subcontractors that violate such restrictions and conditions and shall mitigate the effects of any such violation [45 C.F.R. Sections 164.530(f) and 164.530(e)(1)].
Business Associate’s Subcontractors and Agents. BA shall ensure that any agents and subcontractors that create, receive, maintain or transmit Protected Information on behalf of BA, agree in writing to the same restrictions and conditions that apply to BA with respect to such PHI and implement the safeguards required by paragraph 2.f. above with respect to Electronic PHI [45 C.F.R. Section 164.504(e)(2) through (e)(5); 45 C.F.R. Section 164.308(b)]. BA shall mitigate the effects of any such violation.
Business Associate’s Subcontractors and Agents. BUSINESS ASSOCIATE shall ensure that any agents and subcontractors that create, receive, maintain or transmit Protected Information on behalf of COUNTY, agree in writing to the same restrictions and conditions that apply to COUNTY with respect to such Protected Information and implement the safeguards required by paragraph 2(D) above with respect to Electronic PHI [45 C.F.R. Section 164.504(e)(2)(ii)(D); 45 C.F.R. Section 164.308(b)]. BUSINESS ASSOCIATE shall implement and maintain sanctions against agents and subcontractors that violate such restrictions and conditions and shall mitigate the effects of any such violation (see 45 C.F.R. Sections 164.530(f) and 164.530(e)(1)).

Section 164.504(e)(2)(ii)(D);
Business Associate’s Subcontractors and Agents. SurveyMonkey shall ensure that any agents or subcontractors to whom it provides Protected Information agree to restrictions and conditions comparable to those that apply to SurveyMonkey with respect to such Protected Information. To the extent that SurveyMonkey creates, maintains, receives or transmits PHI on behalf of the CE, SurveyMonkey shall ensure that any of SurveyMonkey’s agents or subcontractors to whom it provides Protected Information agree to implement the safeguards required by Section 2.3 (Appropriate Safeguards) with respect to such PHI.
Business Associate’s Subcontractors and Agents. In accordance with 45 C.F.R. Sections 164.308(b)(2) and 164.502(e)(1)(ii), BA shall ensure that any agents or subcontractors that create, receive, maintain, or transmit PHI on behalf of BA agree in writing to the same restrictions and conditions that apply to BA with respect to such PHI.
Business Associate’s Subcontractors and Agents. Business Associate will require its subcontractors and agents to provide reasonable assurance, evidenced by a written contract that includes obligations consistent with this Agreement with respect to PHI. D. Reporting Non-Permitted Use or Disclosure, Breaches and Security Incidents 1.
Business Associate’s Subcontractors and Agents. DocVerify shall ensure that any agents or subcontractors to whom it provides Protected Information agree to restrictions and conditions comparable to those that apply to DocVerify with respect to such Protected Information. To the extent that DocVerify creates, maintains, receives or transmits EPHI on behalf of the CE, DocVerify shall ensure that any of DocVerify’s agents or subcontractors to whom it provides Protected Information agree to implement the safeguards required by Section 2.3 (Appropriate Safeguards) with respect to such EPHI.
Business Associate’s Subcontractors and Agents. MDprospects & Patient Spectrum shall ensure that any agents or subcontractors to whom it provides Protected Information agree to restrictions and conditions comparable to those that apply to MDprospects & Patient Spectrum with respect to such Protected Information. To the extent that MDprospects & Patient Spectrum creates, maintains, receives or transmits EPHI on behalf of the CE, MDprospects & Patient Spectrum shall ensure that any of MDprospects & Patient Spectrum ’s agents or subcontractors to whom it provides Protected Information agree to implement the safeguards required by Section 2.3 (Appropriate Safeguards) with respect to such EPHI.
Business Associate’s Subcontractors and Agents. BA shall ensure that any agents or subcontractors to whom it provides Protected Information agree to the same restrictions and conditions that apply to BA with respect to such PHI. To the extent that BA creates, maintains, receives or transmits EPHI on behalf of the CE, BA shall ensure that any of BA’s agents or subcontractors to whom it provides Protected Information agree to implement the safeguards required by Section 2.3 above with respect to such EPHI.
