Billing and Related Matters. The Customer shall comply with all relevant laws and legal regulations. The Customer’s liability and indemnity for any acts, omissions or defaults whether in contract, tort (including, without limitation, negligence or breach of statutory duty) under this Agreement shall be limited to £19,500. HANDLING AND STORAGE OF THE EVALUATION UNIT AS WELL AS USING THE EVALUATION UNIT WHICH IS BEYOND BOSTON SCIENTIFIC’s CONTROL MAY DIRECTLY AFFECT THE EVALUATION UNIT AND RESULTS OBTAINED FROM IT. BOSTON SCIENTIFIC SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL LOSS, DAMAGE, OR EXPENSE DIRECTLY OR INDIRECTLY ARISING FROM THE USE OF THE EVALUATION UNIT. Without limiting the generality of the previous provision, the Customer shall not bill or collect from any party any fees or amounts for the use of any Evaluation Unit which it has not purchased or paid for the use of same, except for reporting of performance and material to health insurance companies, including appropriate reimbursement. Furthermore, the Customer agrees to indemnify and hold Boston Scientific and its affiliates, agents, employees, officers, directors, harmless from and against any and all liability, loss, damages, costs and expenses (including, without limitation, reasonable attorney’s fees) which such parties may incur, suffer or be required to pay as a direct result of the Customer’s billing, collection or reimbursement practices and procedures.
