Zadavatel má možnost přiměřeně upravit rozsah požadovaných informací tak, aby byl v souladu s platnými právními předpisy upravujícími oznamovací povinnost nebo jinými státem stanovenými oznamovacími povinnostmi. Bude-li Zdravotnické zařízení v souvislosti s touto Smlouvou vystavovat Poskytovatelům zdravotnických služeb nebo zdravotnickým organizacím nějaké Platby, bude je rovněž informovat o tom, že je povinno takové Platby hlásit. Aby se předešlo pochybnostem, tyto oznamovací povinnosti slouží k zajištění souladu s platnými právními předpisy o oznamování a s povinnostmi Zadavatele hlásit určité skutečnosti státním úřadům. Pro ujasnění, Zdravotnické zařízení bude společnosti IQVIA poskytovat součinnost s cílem usnadnit Zadavateli plnění oznamovacích povinností podle tohoto článku. Tento Článek 12 „Finanční informace a střet zájmů“ zůstane v platnosti po ukončení nebo uplynutí doby trvání této Smlouvy. 13. Finanční informace a střet zájmu Zdravotnické zařízení souhlasí, že na základě žádosti Zadavatele nebo IQVIA Zkoušející pro každého uvedeného a identifikovaného zkoušejícího nebo spoluzkoušejícího, kteří se přímo podílí na léčení nebo hodnocení Subjektů studie neprodleně předá Zadavateli a IQVIA vyplněný a podepsaný formulář finančního prohlášení a konfliktu zájmů, který byl vyplněn a podepsán takovým zkoušejícím nebo spoluzkoušejícím, ve kterém tito zkoušející či spoluzkoušející přiznávají jakékoli příslušné zájmy, které mají oni sami nebo jejich manželé/manželky či nezaopatřené děti. IQVIA je oprávněn pozdržet platby, v případě, že neobdrží vyplněné formuláře od každého takového zkoušejícího a spoluzkoušejícího. Zkoušející zajistí, že veškeré takové formuláře budou neprodleně podle potřeby aktualizovány, aby během Studie a jednoho (1) roku po jejím dokončení byla zachována jejich přesnost a úplnost. Zdravotnické zařízení souhlasí s tím, že vyplněné formuláře mohou kontrolovat státní a regulační úřady, Zadavatel, IQVIA a jejich zástupci, a Zdravotnické zařízení souhlasí s takovými kontrolami. Zdravotnické zařízení dále potvrzuje, že neuzavřelo žádnou smlouvu, která by mu mohla bránit v provádění Studie nebo by mohla znemožnit schválení výsledných údajů kontrolními úřady či případně vyvolat konflikt zájmů. Tento Článek 11 „Finanční informace a střet zájmů“ zůstane v platnosti po ukončení nebo uplynutí doby trvání této Smlouvy. 12.
