Common use of Anti-kickback and Anti Fraud Clause in Contracts

Anti-kickback and Anti Fraud. Institution agrees that its judgment with respect to the advice and care of each Study Subject will not be affected by the compensation it receives from this Agreement, that such compensation does not exceed the fair market value of the services it is providing, and that no payments are being provided to the Institution for the purpose of inducing it to purchase or prescribe any drugs, devices or products. If the Sponsor or Quintiles provides any free products or items for use in the Study, Institution agrees that it will not xxxx any Study Subject, insurer or governmental agency, or any other third party, for such free products or items. Institution agrees that it will not xxxx any Study Subject, insurer, or governmental agency for any visits, services or expenses incurred during the Study for which it has received compensation from Quintiles or Sponsor, or which are not part of the ordinary care it would normally provide for the Study Subject, and that Institution will not pay another physician to refer subjects to the Study.
