Either party Union comprised of not more than two (2) employees of the Employer and/or not more than two (2) Union Representatives may, on behalf of the employee, present the grievance, in writing, to the Hotel General Manager or his designate within seven (7) calendar days after the decision has been received at its discretionStage One, require who shall discuss the employees concerned to matter with the such committee within fourteen (14) calendar days or such other dates as may be present mutually agreed upon by the parties, and to give evidence regarding the dispute. The Company shall provide the Union with its a written decision to not later than seven (7) calendar days after such discussion is concluded. ADJUSTMENT OF GRIEVANCES. 9.01 DifferencesBetween the Company and Employees Should any difference arise between the Company and any of the employees concerning from the interpretation interpretation, application, administration or alleged violation of the provisions of this Agreement, an xxxxxxx effort shall be made to settle such differences without undue delay in the following manner: . Stage One - Within An aggrieved employee may, provided it is done with reasonable promptness, make his representations orally or in writing to the Management Representative designated by the Company from time to time to han- dle such matter at this stage. In making such repre- sentations he may, if he desires, be accompanied and represented by a Grievance Xxxxxxx in his Department or a Grievance Xxxxxxx from his Plant, if there is no Grievance Xxxxxxx available in his Department, and such meeting will normally occur dur- ing the working hours. Any settlement of the grievance reached between the aggrieved employee and the Company at this stage will be considered applicable to the case in question and not as establish- ing a precedent for future cases. If within three (3) days from the time when such representations were presented to such Management Representative a decision satisfactory to the employee is not given, then the grievance may be referred to Stage Two. Such Management Representative shall notify the Local Union of the time and place of a meeting to consider the Company decision was received matter. Any such meeting shall be held within twenty-one (21) days after the written notice of referral has been received. The Local Union shall be represented at such meeting by the General Grievance Committee. If the Local Union notifies the Superintendent of Industrial Relations that there is, in its opinion, a back- log of Stage Three meetings, all Stage Three meetings will then be held on a reorganized basis to permit the holding of concurrent meetings. The Local Union shall be represented at such reorganized meetings by a Chief Grievance Xxxxxxx together with two Grievance Stewards. Such reorganized meetings will be held at the Company’s Copper Cliff offices, or at such other as may be agreed to between the Company and the Local Union, for up to three (3) days each week. The reorganized meeting procedure shall continue until such time as the backlog of Stage Three grievance meetings is, in the opinion of the Local Union, eliminated. Regular days off of both the and the Management Representative involved at each stage, vacation time off of the and recognized holi- days shall not be counted in determining the time with- in which any action is to be taken in each of the fore- going Stages One to Three. The Company will indicate by notice posted for each Department the Management Representatives desig- nated by it from time to time to handle matters in such Department at Stages One and Two of the Grievance Procedure and a copy of each notice posted in the Departments in the Plant shall be given to the Plant Committeeman. If no Management Representative shall have been designated by the Company for any of the stages through which a matter must proceed such matter may proceed directly to the higher stage for which a Management Representative shall have been so des- ignated.

ADJUSTMENT OF GRIEVANCES. 9.01 Should any difference arise between the Company and any of the employees concerning the interpretation inter- pretation or alleged violation of the provisions of this Agreement, an xxxxxxx effort shall be made to settle such differences without undue delay in the following manner: Stage One - Within five (5) days after the grievance has arisen, the employee, accompanied by his/her xxxxxxx may take the matter up with his/her immediate imme- diate supervisor, or the supervisor involved, at which time a grievance fact sheet will be completed and signed by the grievor, the xxxxxxx and the supervisorsupervi- sor. Either party may, at its discretion, require the employees concerned to be present and to give evidence xxx- xxxxx regarding the dispute. The Company shall provide the Union with its written decision to the grievance with- in seven (7) working days after the stage 3 meeting has concluded. Failing a satisfactory settlement the matter may be referred to arbitration within twenty (20) working days as provided in Section Any difference arising directly between the Union and the Company concerning the interpretation,administra- tion or alleged violation of this Agreement (other than con- tract renewal discussions) may be submitted in writing by either party to the other at Stage Three. In determiningthe time within which any step is to be taken under the foregoing provisions of this Article, Saturdays, Sundays, scheduled days off, recognized gener- al holidays, and annual plant shutdowns shall be excluded. If advantage of the provisions of this Article is not taken within the time limit specified or as extended by mutu- al agreement in writing between the Company and the Union, the matter in dispute shall be deemed to have been abandoned and cannot be reopened. The nature of the grievance and the remedy sought shall be set out in the written record at Stage Two and may not be subject to change at Stage Three or in the arbi- tration procedure. The section or sections of this Agreement the meaning of which is in dispute, or which are alleged to have been violated, shall be set out in the written record at Stage Three and may not be subject to change in the arbitration procedure. At any Stage of the Grievance Procedure, if a Xxxxxxx, Chief Xxxxxxx, or Grievance Committee member is unavailable, the senior Union Executive on the property shall delegate a replacement to fulfil the absentee's duties. Disciplinary notations below suspensions shall be withdrawn after a period of months from date of issue, provided the employee has not received subsequent disci- xxxxx in that period. Article ARBITRATION In case any dispute concerning the interpretation or violation of this Agreement has not been settled after pro- ceeding through the proper stages of the grievance proce- dure as set forth, and after the exhaustion of such grievance procedure, the same may be referred by either party to Arbitration within seventwenty (20) days as set forth in Stage Three of the grievance procedure. The grievance will be heard by a single arbitrator, unless the parties mutually agree to submit the matter to a three person Board of Arbitration. In the event a Board is used, all refer- ences herein to Arbitrator, shall be read as referring to a Board of Arbitration. In the event that Company and Union are unable to agree upon the selection of an arbitrator, the Minister of Labour of Canada shall be requested to make the appoint- ment. If arbitration proceedings involve discussion of plant details and processes subject to security rules, it is understood that the arbitrator shall have a security rating acceptable to the Canadian Nuclear Safety Commission. Arbitration shall be heard at the Facility or at such other place as the parties agree upon in writing. The written record of the grievance presented at Stage Three of the grievance procedure and the decision of the Company thereon or in the case of a difference between the Union and the Company, the written application by the applicant for arbitration and the reply thereto by the other party, shall be presented to the Arbitrator. Each xxxxx shall pay an equal share of the fee and expenses of the Arbitrator. No costs of arbitration shall be awarded to or against either party. The decision shall be made at the earliest oppor- tunity after the close of the hearings and the decision of the Arbitrator in respect to an interpretation or alleged violation of this Agreement shall be final and binding upon the parties, but in no event shall the Arbitrator, have power to alter, mod- ify, or amend this Agreement or substitute provisions for any existing provisions, or to give any decisions inconsistent with the terms and provisions of this Agreement. Prior to the arbitration hearing the parties may agree to discuss the grievance in a without prejudice medi- ation process. The mediator will be jointly selected and each party shall pay an equal share of the Mediator’s fees and expenses. Article SENIORITY Definition Seniority shall accumulate throughout the total period an employee has been on the Company’s payroll except that a newly hired employee shall have no seniority rights during his first actual hours worked and
