Assumed Executory Contract and Unexpired Lease Schedule definition

Assumed Executory Contract and Unexpired Lease Schedule means the list of Executory Contracts and Unexpired Leases to be assumed by the Debtors pursuant to the provisions of Article V hereof.
Assumed Executory Contract and Unexpired Lease Schedule means the schedule (as may be amended in accordance with the terms set forth in Article V hereof) of Executory Contracts and Unexpired Leases (including any amendments or modifications thereto) that will be assumed by the Debtors pursuant to the provisions of Article V hereof, as determined by the Debtors. The Assumed Executory Contract and Unexpired Lease Schedule shall include the Debtors’ proposed cure amounts for each of the Executory Contracts and Unexpired Leases, and specify the deadlines for objecting to such proposed cure amounts, and the procedures for having those objections resolved by the Bankruptcy Court (if necessary).
Assumed Executory Contract and Unexpired Lease Schedule means the schedule (as may be amended in accordance with the terms set forth in Article V hereof) of Executory Contracts and Unexpired Leases (including any amendments or modifications thereto) that will be assumed by the Debtors pursuant to the provisions of Article V hereof, as determined by the Debtors with the consent of the Requisite Plan Sponsors and included in the Plan Supplement.

Examples of Assumed Executory Contract and Unexpired Lease Schedule in a sentence

  • Entry of the Confirmation Order by the Bankruptcy Court shall constitute approval of such rejections and the assumption of the Executory Contracts or Unexpired Leases listed on the Assumed Executory Contract and Unexpired Lease Schedule pursuant to sections 365(a) and 1123 of the Bankruptcy Code.

  • Safety sensitive employees who are prescribed medical marijuana may be subject to review by a City designated MRO and they must immediately report the intent to use medical marijuana to their supervisor or Human Resources under the provisions of the Arizona Medical Marijuana Act.

  • The Debtors shall file and serve upon the counterparties (and their counsel, if known, by electronic mail) an amended and restated Assumed Executory Contract and Unexpired Lease Schedule indicating anymodifications to the initial Assumed Executory Contract and Unexpired Lease Schedule no later than five (5) business days prior to the Voting Deadline.

  • As part of the Plan Supplement, the Debtors shall File an Assumed Executory Contract and Unexpired Lease Schedule, which Schedule shall identify the Executory Contracts and Unexpired Leases to be assumed by the Debtors pursuant to the Plan and shall include any amounts of Cure to be paid in connection therewith.

  • Reservation of RightsNeither the exclusion nor inclusion of any Executory Contract or Unexpired Lease on the Assumed Executory Contract and Unexpired Lease Schedule, nor anything contained in the Plan, shall constitute an admission by the Debtors that any such contract or lease is in fact an Executory Contract or Unexpired Lease or that any of the Debtors has any liability thereunder.

  • Exhibit F to the PlanSupplement contained the Assumed Executory Contract and Unexpired Lease Schedule (as defined in the Plan).PLEASE TAKE FURTHER NOTICE THAT, on December 14, 2020 [see Docket No. 280], the Debtors filed a second Plan Supplement, which included a supplement to the Assumed Executory Contract and Unexpired Lease Schedule.

  • The Assumed Executory Contract and Unexpired Lease Schedule remains subject to all of the terms and conditions provided for therein.

Related to Assumed Executory Contract and Unexpired Lease Schedule

  • Assumed Executory Contract and Unexpired Lease List means the list, as determined by the Debtors or the Reorganized Debtors, as applicable, of Executory Contracts and Unexpired Leases (with proposed cure amounts) that will be assumed by the Reorganized Debtors, which list shall be included in the Plan Supplement.

  • Rejected Executory Contract and Unexpired Lease List means the list, as determined by the Debtors or the Reorganized Debtors, as applicable, of Executory Contracts and Unexpired Leases that will be rejected by the Reorganized Debtors pursuant to the Plan, which list shall be included in the Plan Supplement.

  • Schedule of Rejected Executory Contracts and Unexpired Leases means the schedule (including any amendments or modifications thereto), if any, of the Executory Contracts and Unexpired Leases to be rejected by the Debtors pursuant to the Plan, as set forth in the Plan Supplement, as amended by the Debtors from time to time in accordance with the Plan, which shall be in form and substance acceptable to the Debtors.

  • Schedule of Assumed Executory Contracts and Unexpired Leases means the schedule of certain Executory Contracts and Unexpired Leases to be assumed (or assumed and assigned) by the Debtors pursuant to the Plan, as the same may be amended, modified, or supplemented from time to time by the Debtors.

  • Executory Contract means a contract to which one or more of the Debtors is a party that is subject to assumption or rejection under sections 365 or 1123 of the Bankruptcy Code.

  • Executory Contracts means executory contracts and unexpired leases as such terms are used in 11 U.S.C. § 365, including all operating leases, capital leases, and contracts to which the Debtor is a party or beneficiary on the Confirmation Date.

  • Unexpired Lease means a lease to which one or more of the Debtors is a party that is subject to assumption or rejection under section 365 of the Bankruptcy Code.

  • Assumed Leases has the meaning set forth in Section 2.6(b).

  • Assumed Contract means any Executory Contract or Unexpired Lease assumed by the Reorganized Debtors in accordance with Article V of the Plan.

  • Service Contracts means contracts or agreements, such as maintenance, supply, service or utility contracts.

  • Assumed Contracts has the meaning set forth in Section 2.1(d).

  • Customer Contracts has the meaning set forth in Section 1.1(b)(ii)(A).

  • Assigned Leases has the meaning specified in Section 2.01(b).

  • Prepaid contract means any Contract that has terminated or been prepaid in full prior to its scheduled expiration date (including because of a Casualty Loss), other than a Defaulted Contract.

  • CFD Contract or "CFD" shall mean a contract which is a contract for difference by reference to fluctuations in the price of the relevant security or index;

  • Customer Contract means any written contract or agreement (other than trade contracts) between Seller and any of its customers (or under which Seller has rights) which has been entered into and signed by the parties thereto in connection with the publication of the Directories and corresponding provision of Directory Services.

  • Assumed Agreements shall have the meaning as set forth in Section 2.2.

  • Assigned Contract has the meaning set forth in Section 1.5(a).

  • Non Contract Player means any Player (other than a Player on a Scholarship) who is eligible to play for a Club but has not entered into a written contract of employment.

  • Assigned Contracts has the meaning set forth in Section 2.01(c).

  • Recorded Leasehold Interest means a Leasehold Property with respect to which a Record Document has been recorded in all places necessary or desirable, in the Collateral Agent’s reasonable judgment, to give constructive notice of such Leasehold Property to third-party purchasers and encumbrances of the affected real property.

  • Claims Bar Date Order means that certain order entered by the Bankruptcy Court establishing the Claims Bar Date.

  • Contract Schedule means a schedule to this Contract;

  • Business Contracts has the meaning ascribed to it in Section 1.01(a)(v).

  • Key Sub-Contract means each Sub-Contract with a Key Sub-Contractor;

  • Initial Contracts means those Contracts conveyed to the Trust on the Closing Date.
