  • The effectiveness of this Amendment is expressly conditioned upon receipt by Agent of the following: (i) Agent shall have received completed reference checks (including compliance with Section 326 of the US Patriot Act) with respect to the Xtellus Entities, the results of which are satisfactory to Agent in its sole discretion, and (iii) a fully executed copy of this Amendment.
