Simultaneous Use of Area. STATE reserves the right to issue written authorization to others to use the areas of operations, in the determination of STATE, such use will not materially interfere with the operations of PURCHASER. During the period of this contract, STATE reserves the right to sell any products or materials from the areas of operations, provided that the products or materials are not covered by this contract and that removal will not materially interfere with the operations of PURCHASER. PURCHASER shall not interfere with the use of roads by other authorized users. PURCHASER shall not be held liable for any acts, omissions, or neglect of authorized simultaneous users. PAYMENTS AND ACCOUNTABILITY Section 42. Payment Schedule. The purchase price in Section 44 of the contract shall be paid in 5 installments, as follows: The first installment shall be paid within 30 days of the notification of high bid or before operating, whichever occurs first. The first installment shall be the purchase price divided by 5. Cash bid deposits shall be applied to this payment. The amount of the subsequent installments shall be calculated by dividing the total bid value, less the initial payment, by 4. The second installment shall be paid before log hauling, except for the removal of trees which are felled for road construction required by this contract; and provided the value of the timber removed is less than one-half the amount of an installment payment. Subsequent installments shall be paid when the value of timber removed equals 20, 40, and 60 percent of the purchase price. The full purchase price shall be paid on or before August 31, 2004. Second and subsequent installments must be received by STATE within the time period stated on the instrument requesting payment. PURCHASER's deposit account shall not accrue interest payable to PURCHASER.

  • SPECIFIC TERMS AND CONDITIONS To the extent that Contractor has received an award for Lot 4, Implementation Services, the following terms and conditions apply to Lot 4 Implementation Services. All Services covered under Lot 4 – Implementation Services must be performed within CONUS. REQUEST FOR QUOTATION (RFQ) TRANSACTION PROCESS An RFQ for this Lot will be awarded based on, and result in, a deliverable-based Statement of Work (SOW) which will be incorporated into an Authorized User Agreement. All responses to RFQs must include detailed price information, including but not limited to: hours required per title, cost per hour, etc. Travel, lodging and per diem costs must be itemized in the total quote and may not exceed the rates in the NYS OSC Travel Policy. OGS recognizes the need to promote the employment of service-disabled veterans and to ensure that certified service-disabled veteran-owned businesses have opportunities for maximum feasible participation in the performance of OGS contracts. In recognition of the service and sacrifices made by service-disabled veterans and in recognition of their economic activity in doing business in New York State, Bidders are expected to consider SDVOBs in the fulfillment of the requirements of the Contract.   • Use of Premises The Premises shall be used and occupied by Tenant and Tenant's immediate family, consisting of , exclusively, as a private single family dwelling, and no part of the Premises shall be used at any time during the term of this Agreement by Tenant for the purpose of carrying on any business, profession, or trade of any kind, or for any purpose other than as a private single family dwelling. Tenant shall not allow any other person, other than Tenant's immediate family or transient relatives and friends who are guests of Tenant, to use or occupy the Premises without first obtaining Landlord's written consent to such use. Tenant shall comply with any and all laws, ordinances, rules and orders of any and all governmental or quasi-governmental authorities affecting the cleanliness, use, occupancy and preservation of the Premises.
