The GMS Regulations (Schedule 6, paragraph 65(2)(b)) and the PMS Regulations (Schedule 1, paragraph 34(6)(b)) respectively state that GMS contracts and PMS Agreements must include “a term that requires the Health Board and the contractor to act jointly as data controllers in relation to the processing of patient records.” This Agreement is designed to support GP Contractors and Health Boards set out their Joint Controller arrangements.
