Owner Indemnified Persons definition

Owner Indemnified Persons has the meaning set forth in Section 11.2.

Examples of Owner Indemnified Persons in a sentence

• The Contractor shall indemnify and hold the Owner Indemnified Persons harmless from and against Claims arising out of the Contractor’s performance of the Contract which are attributable to an infringement or an alleged infringement of a patent of invention by the Contractor or anyone for whose acts the Contractor may be liable, and this indemnity shall be deemed to be included in the terms of the indemnity set out in GC 12.1.1.

• Owner Indemnified Persons has the meaning given to it in GC 12.1.1.

• Tarmac surface is the least expensive option, but this would be replacing ‘like for like’ and tarmac is widely considered unsuitable.

• Each Party may elect, in its sole discretion, to exercise or not exercise indemnification rights under this Agreement on behalf of the applicable Owner Indemnified Persons, in the case of the Project Operator, and the applicable Project Operator Indemnified Persons, in the case of the Owners.

• Notwithstanding any provision of this Agreement to the contrary, in no event shall Provider be liable to Owner Indemnified Persons for an amount in excess of the total fees paid to Provider under this Agreement.
