Non-Serviced Mortgage Loan Pooling and Servicing Agreement means a pooling and servicing agreement under which a Non-Serviced Mortgage Loan is serviced. There are no Non-Serviced Mortgage Loan Pooling and Servicing Agreements related to the Trust.

• Notwithstanding the foregoing, the terms of this Section 6.9 shall not be applicable to any Non-Serviced Mortgage Loan if the applicable Non-Serviced Mortgage Loan Special Servicer shall have performed such obligations with respect to such Mortgage Loan pursuant to the terms of the related Non-Serviced Mortgage Loan Pooling and Servicing Agreement.

• The applicable Non-Serviced Mortgage Loan Master Servicer is obligated to make Servicing Advances pursuant to the related Non-Serviced Mortgage Loan Pooling and Servicing Agreement with respect to any Non-Serviced Mortgage Loan, and the Master Servicer shall not have any obligation to make Servicing Advances with respect to such Mortgage Loan.

• The applicable Non-Serviced Mortgage Loan Master Servicer is obligated to make “Servicing Advances” as defined in, and pursuant to, the related Non-Serviced Mortgage Loan Pooling and Servicing Agreement with respect to any Non-Serviced Mortgage Loan, and 158 the Master Servicer shall have no obligation or authority to make Servicing Advances with respect to such Non-Serviced Mortgage Loan.

Non-Serviced Mortgage Loan Pooling and Servicing Agreement means a pooling and servicing agreement under which a Non-Serviced Mortgage Loan is serviced. The only Non-Serviced Mortgage Loan Pooling and Servicing Agreement related to the Trust as of the Closing Date is the MSBAM 2013-C9 Pooling and Servicing Agreement, pursuant to which the Milford Plaza Fee Mortgage Loan and the Milford Plaza Fee -Serviced Companion Loan are serviced. On and after The Mall at Txxxxx Crossing Companion Loan Securitization Date, the pooling and servicing agreement entered into in connection with the securitization of The Mall at Txxxxx Crossing Companion Loan shall be a Non-Serviced Mortgage Loan Pooling and Servicing Agreement.

With respect to each of the State Farm Portfolio Mortgage Loan and the Marriott Philadelphia Downtown Mortgage Loan, following the securitization of the controlling portion of the related Non-Serviced Companion Loan, the pooling and servicing agreement entered into in connection with such securitization will be the Non-Serviced Mortgage Loan Pooling and Servicing Agreement with respect to the related Mortgage Loan.
