New Store definition

New Store has the meaning given in Section 2.2.
New Store any Store not previously in existence at a location, provided that a relocation of any Store within the same building, strip mall or retail mall shall not be considered a New Store. Notwithstanding the foregoing provision, the definition of New Store shall at all times be consistent with the Company’s reporting of the opening of new Stores in all financial statements and reports that any member of the Restricted Group makes to, or files with, the SEC or provides to the holders of any class of its debt securities or public equity securities.
New Store means, on any date of determination, each new entertainment and dining venue or other facility that (i) commenced operations during the 12 months preceding the last day of the most recently ended fiscal period for which financial statements have been delivered pursuant to Section 4.02(a)(1), (ii) has been operating for less than 12 months, and (iii) is still in operation as of the last day of the most recently ended fiscal period for which financial statements have been delivered pursuant to Section 4.02(a)(1).

Examples of New Store in a sentence

  • The term "New Store" shall not be taken to mean a "remodel" store.

  • In the case of New Store openings where two (2) or more employees commence work on the same date, their seniority shall be determined at the end of thirty (30) days.

  • In the case of New Store openings where two (2) or more employees commence work on the same date, their seniority shall be determined at the end of sixty (60) days.

  • The term "New Store" shall also be taken to mean a "remodel" where the size of the store is increased.

  • If the Employer transfers employees from one Contract Area to another for the purpose of staffing a New or Replacement Store, such employees shall hold the seniority they had immediately prior to being transferred to the New Store.


More Definitions of New Store

New Store means a Company store for which any one of the first 24 “full fiscal periods” occurs during the Performance Period, but shall not include a Company store as a result of a reopening or relocation during the Performance Period.
New Store means, with respect to any Person for any period, any newly constructed store that is in operation on the last day of such period, but that has not been in operation for more than eleven (11) full fiscal months, and that is owned by such Person or any of its Restricted Subsidiaries.
