  • Where appropriate, any such arrangements will comply with the requirements of Article 11 of the MiFID II Delegated Directive.

  • Article 16(3) MiFID II and Articles 9 and 10 of the MiFID II Delegated Directive require manufacturers and distributors to review products on a regular basis to assess whether the product remains consistent with the needs, characteristics and objectives of the identified target market and whether the intended distribution strategy remains appropriate.

  • In line with Recital 20 of the MiFID II Delegated Directive, relevant information could include, for example, information on which distribution channels have been employed, the proportion of sales made outside the target market, summary information of the types of client, a summary of any complaints received and questions suggested by the manufacturer to a sample of clients for feedback.

  • Where appropriate, any such arrangements will comply with the requirements of Article 11 of MiFID II Delegated Directive.

  • Furthermore, Article 9(10) of the MiFID II Delegated Directive requires manufacturers ‘to undertake a scenario analysis of their financial instruments which shall assess the risks of poor outcomes for end clients posed by the product and in which circumstances these outcomes may occur.

  • If the product is deemed appropriate for a sale without advice, the firm could also specify the preferred acquisition channel.6 See Recital 19 of the MiFID II Delegated Directive.
