Loss Leader Product definition

Loss Leader Product means units of ArterX which are sold to a customer at a discount (excluding customary or other commercially reasonable discounts applied for purposes that do not include inducing the purchase of other products from Parent) exceeding 30% of the average sales price at which ArterX was sold to such customer during the three (3) month period immediately preceding the month in which ArterX was sold with such discount, provided that with respect to the initial sale of ArterX to a customer, it shall be considered a Loss Leader Product if ArterX is sold to a customer at a discount (excluding customary or other commercially reasonable discounts applied for purposes that do not include inducing the purchase of other products from Parent) that exceeds 30% of the average sales price at which ArterX was sold during the three (3) month period preceding the month in which such initial sale occurs to other similarly situated customers of Parent which are also located in the same territory as such customer, provided in each case that such discount was offered together with, and conditional upon, the purchase by such customer at the same time of products of Parent other than ArterX.

  • Tobacco product manufacturer means an entity that after the date of enactment of this act directly (and not exclusively through any affiliate) meets 1 or more of the following:

  • Final Product means a product that is not used in producing other products and is built and intended for use outdoors, provided the final product has not deteriorated or has otherwise become a potential source of contaminants.

  • Commercial Product means any such product as defined in FAR 2.101.

  • Collaboration Product means any pharmaceutical product in finished form that contains a Collaboration Compound, either as the sole active ingredient or in combination with one or more other active ingredients, and all present and future formulations, dosages and dosage forms thereof.

  • Product means any deliverable under the Contract, which may include commodities, services, technology or software.

  • Licensed Product means any pharmaceutical product containing a Licensed Compound (alone or with other active ingredients), in all forms, presentations, formulations and dosage forms.

  • Hemp product means the same as that term is defined in § 3.2-4112.

  • Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except—

  • Tobacco product means any substance containing tobacco leaf, including but not limited to, cigarettes, cigars, pipe tobacco, hookah tobacco, snuff, chewing tobacco, dipping tobacco, bidis, blunts, clove cigarettes, or any other preparation of tobacco; and any product or formulation of matter containing biologically active amounts of nicotine that is manufactured, sold, offered for sale, or otherwise distributed with the expectation that the product or matter will be introduced into the human body by inhalation; but does not include any cessation product specifically approved by the U.S. Food and Drug Administration for use in treating nicotine or tobacco dependence.

  • Finished Product means a cannabis product in its final form to be sold at a retail premises.

  • U.S. Territory means American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, the Commonwealth of Puerto Rico, or the U.S. Virgin Islands.

  • Drug store means a place whose principal business is, the

  • Approved Product means any water fitting, plumbing product, material or component which is the subject of an existing WRAS Approval;

  • Hemp products means all products made from industrial hemp,

  • Bulk Product means Licensed Product supplied in a form other than Finished Product which can be converted into Finished Product.

  • API means American Petroleum Institute.

  • Clinical peer means a physician or other health care professional who holds a non-restricted license in a state of the United States and in the same or similar specialty as typically manages the medical condition, procedure or treatment under review.
