Litigation Trust Assets definition

Litigation Trust Assets means the Litigation Trust Claims.

Litigation Trust Assets means the Litigation Trust Claims, the Litigation Trust Funds and any other assets acquired by the Litigation Trust on or after the Effective Date pursuant to the Litigation Trust Agreement or the Plan.

Litigation Trust Assets means the Non-Settling Defendant Claims, Assigned Preference Claims and any Cash contributed to the Litigation Trust.

Examples of Litigation Trust Assets in a sentence

• All Litigation Trust Interests shall be satisfied solely out of Litigation Trust Assets, and Holders of Allowed Claims in the General Unsecured Classes shall not have recourse to Reorganized Greektown for unpaid portions of any Litigation Trust Interest.

• The Litigation Trustee shall be responsible for all decisions and duties with respect to the Litigation Trust and the Litigation Trust Assets.

• Notwithstanding the foregoing, all net proceeds of such Litigation Trust Assets shall be transferred to the Litigation Trust to be distributed to the Litigation Trust Beneficiaries consistent with the terms of the Plan and the Litigation Trust Agreement.

• The Litigation Trust Beneficiaries will thereafter be treated for U.S. federal income tax purposes as the grantors and deemed owners of their respective shares of the Litigation Trust Assets.

Litigation Trust Assets means all Preserved Causes of Action, including any proceeds therefrom, and any interest and earnings on such proceeds.

Litigation Trust Assets means those rights, claims or other assets to be transferred to and owned by the Litigation Trust pursuant to Section 5.8 of the Plan for the benefit of each of Classes 4, 5, 6, and 7, which are comprised of (i) the Litigation Trust Initial Deposit, (ii) the Potential Tax Refunds, (iii) all of the Debtors' rights and standing to object to, litigate, settle and otherwise resolve (a) the Tobacco Causes of Action, (b) the Avoidance Actions and (c) the Material Rights of Action, and (iv) any and all proceeds of the foregoing and interest actually earned. Litigation Trust Assets shall not include the FB Reversions.

Litigation Trust Assets means the Litigation Trust Payment and the Litigation Trust Causes of Action and all proceeds of the foregoing. For the avoidance of doubt, the Litigation Trust Assets shall not include the Retained Causes of Action.

Litigation Trust Assets means (a) the Specified Causes of Action and (b) the Litigation Trust Funds.

Litigation Trust Assets means all Preserved Causes of Action, including any proceeds therefrom, and any interest and earnings on such proceeds; provided, however, Litigation Trust Assets shall exclude Disclaimed State Law Avoidance Claims and Step Two-LBO Related Causes of Action (other than disgorgement claims) to avoid, disallow or subordinate Step Two Senior Loan Claims and/or Step Two Senior Loan Guaranty Claims, including any proceeds therefrom, and any interest and earnings on such proceeds.

Litigation Trust Assets means (i) all Avoidance Claims belonging to Casino, Holdings II, Builders, Realty, and Trappers, (ii) all Avoidance Actions belonging to Holdings, including the Unsettled Bond Avoidance Action Claims (iii) the proceeds of the Litigation Trust Loan, (iv) the Litigation Claims Proceeds, and (v) any proceeds, including interest, of the foregoing assets.

Litigation Trust Assets means the Litigation Trust Causes of Action and the Litigation Trust Proceeds.
