The Department shall waive the survey requirement if an entire site is covered by Highlands open waters and/or their buffers.
N.J.A.C. 7:38‐3.6 states that there shall be a 300‐foot buffer adjacent to Highlands open waters in which no disturbance is permitted, except as provided in this chapter.
