Form of Application means a form of application to become a member of Pool Re, in the form set out in Schedule 3 or in such other form as Pool Re may specify.
Application an application, in such form as the Issuing Lender may specify from time to time, requesting the Issuing Lender to open a Letter of Credit.
Commissioner means the commissioner of insurance.
Department means the department of health.
Secretary means the Secretary of the Department of Health and Human Services or his designee.
Documentation means SAP's then-current technical and functional documentation as well as any roles and responsibilities descriptions, if applicable, for the Cloud Service which is made available to Customer with the Cloud Service.
Code means the Internal Revenue Code of 1986, as amended.
Division means the division of the assets, liabilities and/or obligations of a Person (the “Dividing Person”) among two or more Persons (whether pursuant to a “plan of division” or similar arrangement), which may or may not include the Dividing Person and pursuant to which the Dividing Person may or may not survive.
Software means computer programs, whether in source code or object code form (including any and all software implementation of algorithms, models and methodologies), databases and compilations (including any and all data and collections of data), and all documentation (including user manuals and training materials) related to the foregoing.
Site means the place or places where the permanent Works are to be carried out including workshops where the same is being prepared.
User means a person, department or other administrative unit of the City authorized by the Contract Administrator to order Work under this Contract;
Agent means any Registrar or Paying Agent.
State means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States.
Contractor means the individual or entity, that has entered into this contract with the Commonwealth.
Order means an official written order issued for the supply of goods or works or the rendering of a service.
Manufacture means the production of products in a factory using labour, materials, components and machinery and includes other related value-adding activities.
Project means the goods or Services described in the Signature Document or a Work Order of this Contract.
Local content means that portion of the bidding price which is not included in the imported content provided that local manufacture does take place.
Contract Price means the price payable to the supplier under the contract for the full and proper performance of his contractual obligations.
Government means the Government of Kenya;
City means the City of Tulsa, Oklahoma.
Delivery means delivery in compliance of the conditions of the contract or order.
Subcontractor means any supplier, distributor, vendor, or firm that furnishes supplies or services to or for a prime contractor or another subcontractor.
Produced in the United States means, for iron and steel products, that all manufacturing processes, from the initial melting stage through the application of coatings, occurred in the United States.
Corrupt practice means the offering, giving, receiving, or soliciting of anything of value to influence the action of a public official in the procurement process or in contract execution.
Written or “in writing” means handwritten in ink or any form of electronic or mechanical writing.
Amendment means a written agreement, signed by the Parties, which documents changes to the Contract other than those permitted by Work Orders.
