Existing Investor II definition

Existing Investor II has the meaning given in the opening of this Agreement.
Existing Investor II means FORBION Co-Investment COÖPERATIEF U.A., represented by its managing director Forbion 1 Management B.V.;
Existing Investor II means Tata Capital Growth Fund II, a fund registered under the Securities and Exchange Board of India (Alternate Investment Funds) Regulations, 2012 as a Category II Alternate Investment Fund established as an irrevocable trust under Indian Trusts Act, 1882 through the indenture dated 9 February 2017, as amended from time to time acting through its trustee, Tata Trustee Company Limited, represented by Tata Capital Limited, the investment manager, a company incorporated under the provisions of Companies Act, 1956 and having its registered office at Tower A 1101 Peninsula Business Park, Ganpatrao Kadam Marg, Lower Parel, Mumbai.

Related to Existing Investor II

  • Existing Investors shall have the meaning given in the Preamble hereto.

  • Defaulting Investor means any Investor that has (a) failed to make a payment required to be made by it under the terms of this Agreement within one (1) Business Day of the day such payment is required to be made by such Investor thereunder, (b) notified the Administrative Agent in writing that it does not intend to make any payment required to be made by it under the terms of this Agreement within one (1) Business Day of the day such payment is required to be made by such Investor thereunder or (c) become the subject of an Event of Bankruptcy.
