Damage or Deterioration definition

Damage or Deterioration shall have the definition set forth in Section 7.6 of Article VII Operation, Maintenance, ------------------------ and Repair of the System of this Agreement. ------------------------

Examples of Damage or Deterioration in a sentence

  • FTV and ▇▇▇ shall cooperate reasonably with each other to collect any available insurance proceeds and to resolve any disputes with insurance carriers regarding the availability of insurance proceeds to repair any Damage or Deterioration to the System.

  • However, if the Damage or Deterioration is due to the negligence or willful misconduct of FTV or ▇▇▇, the party responsible for such Damage or Deterioration shall be responsible for the costs of repairing the System to the extent the Damage or Deterioration was caused by such party.

  • In the event ▇▇▇ notifies FTV of a need for repair to the System, or of damage to the System that results from a specific accident or disaster, or deterioration of the fibers in the System requiring replacement of fibers ("Damage or Deterioration"), FTV, at its cost, shall promptly repair such Damage or Deterioration using its best efforts as defined in Paragraph VII.D. above.

  • However, if the Damage or Deterioration is due to the negligence or willful misconduct of EBS or Customer, the party responsible for such Damage or Deterioration shall be responsible for the costs of repairing the System to the extent the Damage or Deterioration was caused by such party.

  • Customer shall pay EBS' invoice for Customer's Proportionate Share (as hereinafter defined) of the cost to repair the Damage or Deterioration, within thirty (30) days after receipt of the invoice.

  • Vyvx shall pay IXC (1) **** per month, payable at the end of each month and (2) **** (as defined below), for performance of the maintenance and repair services (excluding the cost of repairing IXC Damage or Deterioration) set forth in this Article.

  • Vyvx shall pay IXC's invoice for Vyvx's proportional amount of the cost to repair the IXC Damage or Deterioration within thirty (30) days after receipt of the invoice.

  • EBS and Customer shall reasonably cooperate with each other to collect any available insurance proceeds or other recoverable amounts and to resolve any disputes with insurance carriers regarding the availability of insurance proceeds to repair any Damage or Deterioration to the System.

Related to Damage or Deterioration

  • Damage means actual and/or physical damage to tangible property;

  • Repair means the reconstruction, replacement, or renewal of any part of an existing building for the purpose of its maintenance or to correct damage.

  • Contamination means the presence of, or Release on, under, from or to the environment of any Hazardous Substance, except the routine storage and use of Hazardous Substances from time to time in the ordinary course of business, in compliance with Environmental Laws and with good commercial practice.

  • Elevated Building means a non-basement building which has its lowest elevated floor raised above ground level by foundation walls, shear walls, posts, piers, pilings, or columns.

  • Deteriorated paint means any interior or exterior paint or other coating that is peeling, chipping, chalking or cracking, or any paint or coating located on an interior or exterior surface or fixture that is otherwise damaged or separated from the substrate.
