Winter Maintenance Easement. Grantor hereby sells, bargains, grants, quitclaims, conveys, assigns, establishes, and creates to and for the benefit of Grantee, its successors and assigns, for Grantee’s use and the use of Grantee’s agents, contractors, tenants, employees, customers, licensees, guests and invitees, a perpetual, non-exclusive easement over and across the Road during the winter1 (including any future widening, or relocation/re-alignment of the Road as may occur under paragraph 10 below) to plow the Road for w heeled m otor vehicleular winter access to and from Grantee’s Property (“WME” or “Easement”). The WME shall be an easement appurtenant to Grantee’s Property and shall inure to the benefit of Grantee’s heirs, successors, assigns and personal representatives, subject to the conditions set forth herein. The WME shall run with the land of Grantor and Grantee. The WME may not be transferred, assigned or conveyed apart or separately from the Grantee’s Property, EXCEPTING the assignment of rights as set forth under Section 3(e) below. This WME may terminate or be suspended in accordance with paragraph 4 below.

  • Property Maintenance Maintain all of its property that is necessary to or useful in the proper conduct of its business in good working condition, ordinary wear and tear excepted.

  • Site Maintenance The authorized area shall be maintained in a neat, clean, and safe condition, free of any solid waste, debris, or litter, except as specifically authorized herein.

  • System Maintenance The Trust understands that USBFS will perform periodic maintenance to the System(s), which may cause temporary service interruptions. Forest Service must agree to this plan. If the commercial users cannot agree on main- tenance responsibilities, Forest Service shall resolve the differences. If Purchaser elects to use different roads than those listed in C5.31, Forest Service shall determine Pur- chaser’s commensurate share of road maintenance and revise road maintenance deposits in C5.32. If Forest Service cannot perform its full commensu- rate share of road maintenance, Forest Service shall make a cash payment to Purchaser for performance of such work. Unless agreed in writing, prehaul maintenance shall be completed on any portion of road prior to hauling on that portion. Maintenance, as used in this contract, does not include road reconstruction or repairs of an extraordi- nary nature.

  • Operating and Maintenance Costs The Participating Generator shall be responsible for all its costs incurred in connection with operating and maintaining the Generating Units identified in Schedule 1 for the purpose of meeting its obligations under this Agreement.

  • Construction and Maintenance There are on-going maintenance, renovation and construction projects taking place in and around the residences. The work typically takes place during regular business hours, but may begin earlier or extend into evenings or weekends. On-going construction or renovation projects will continue through midterm and final exam periods. The University will take measures to ensure that prudent construction practices are followed, but there may be noise, dust and temporary interruption of some services. Residents may be required to temporarily or permanently relocate to facilitate construction or renovation to their residence area. There will be no compensation or reduction to your residence fees due to disruption and/or relocation.
