Common use of USE OF ARCHITECT'S INSTRUMENTS OF SERVICE Clause in Contracts

USE OF ARCHITECT'S INSTRUMENTS OF SERVICE. 6.1 The Drawings, Specifications and other documents, including those in electronic form, prepared by the Architect and its Consultants for this Project are Instruments of Service. The Instruments of Service shall become the joint property of the School District and Architect and, unless otherwise provided, the Architect shall be deemed the author of these Instruments of Service. The Architect grants the School District a non-exclusive license to use and reproduce, and the School District may use and reproduce, the Instruments of Service for purposes of constructing, using, maintaining and adding to the Project. Reproducible copies, including electronic copies, may be retained by the School District, whether the Project for which they were created is executed or not, and both the School District and the Architect are entitled to make and retain copies and reproduce them for their own use. The School District will indemnify and hold harmless the Architect, its agents and employees, from any claims arising from the School District's use of the Instruments of Service on projects for which the Architect is not employed.
