Unpaved S. 98th Street. The Parcel Owners acknowledge that any Parcel Owner may submit a final plat, subdividing said Parcel Owner’s Parcel of the Property prior to construction of Xxxx Xxxx X. 00xx Xxxxxx or the S. 98th Street First Phase. The parties agree that until that abutting portion of S. 98th Street is paved no abutting buildable lots may be final platted between unpaved S. 00xx Xxxxxx and a paved Internal Street (defined below) running parallel to S. 98th Street. In the event an Internal Street does not run parallel to S. 98th Street, no buildable lots may be final platted within 110 feet of unpaved S. 98th Street. While this limitation may cause some hardships and inefficiencies in development, it will permit final platting to proceed forward without the corresponding requirement to pave any abutting section of S. 98th Street.

  • Shared Transport The Shared Transport Network Element (“Shared Transport”) provides the collective interoffice transmission facilities shared by various Carriers (including Qwest) between end-office switches and between end-office switches and local tandem switches within the Local Calling Area. Shared Transport uses the existing routing tables resident in Qwest switches to carry the End User Customer’s originating and terminating local/extended area service interoffice Local traffic on the Qwest interoffice message trunk network. CLEC traffic will be carried on the same transmission facilities between end- office switches, between end-office switches and tandem switches and between tandem switches on the same network facilities that Qwest uses for its own traffic. Shared Transport does not include use of tandem switches or transport between tandem switches and end-office switches for Local Calls that originate from end users served by non- Qwest Telecommunications Carriers (“Carrier(s)”) which terminate to QLSP End Users.

  • Excessive Load Company hereby agrees that it will use all paved and floor areas as constructed and in accordance with the permitted use of such areas, and Company will prohibit its Company Parties from placing excessive loads on paved or floor areas on the Premises or Common Use Areas. Company will be responsible for the repair of any paved or floor area damaged by non-conforming usage or excessive loading.
