Under the Wxxxxx. Xxxxxxx State Energy Resources Conservation and Development Act (“Wxxxxx-Xxxxxxx Act”), beginning at Section 25500 of the Public Resources Code, construction and operation of the Mxxxxxx Energy Center is subject to approval by the California Energy Commission (“CEC” or the “Commission”), which is given the exclusive authority to certify (approve) sites and related facilities for any proposed power plant over 50-megawatts in generating capacity. Under the Wxxxxx-Xxxxxxx Act, such approval by the CEC is in lieu of any permit, certificate, or similar document required by any state, local or regional agency, or federal agency to the extent permitted by federal law, for such use of the site and related facilities, and supersedes any applicable statute, ordinance, or regulation of any state, local, or regional agency, or federal agency to the extent permitted by federal law.

  • Actions Taken Under the Program The actions taken by the Recipient under the Program include the following:

  • Coverage Under the Minnesota Advantage Health Plan From July 1, 2019 through December 31, 2019, health coverage under the SEGIP will continue at the level in effect on June 30, 2019. Effective January 1, 2020, Advantage will cover eligible services subject to the copayments, deductibles and coinsurance coverage limits stated. Services provided through Advantage are subject to the managed care procedures and principles, including standards of medical necessity and appropriate practice, of the plan administrators.   • IMPLICATIONS UNDER THE LISTING RULES As the relevant percentage ratios (as defined under the Listing Rules) in respect of the maximum amount of financial assistance granted to the Borrowers or their associates pursuant to the Loan Facility under the Loan Agreement exceed 5% but are under 25%, the transaction contemplated under the Loan Agreement constitutes a discloseable transaction of the Company and is therefore subject to the announcement requirement but exempt from Shareholders’ approval requirement under the Listing Rules.
