The Contracting Authority and Sample Clauses

The Contracting Authority and the Supplier shall keep confidential and shall not, without the written consent of the other party hereto, divulge to any third party any documents, data, or other information furnished directly or indirectly by the other party hereto in connection with the Contract, whether such information has been furnished prior to, during or following completion or termination of the Contract. Notwithstanding the above, the Supplier may furnish to its Subcontractor such documents, data, and other information it receives from the Contracting Authority to the extent required for the Subcontractor to perform its work under the Contract, in which event the Supplier shall obtain from such Subcontractor an undertaking of confidentiality similar to that imposed on the Supplier under GCC Clause 19.

The Contracting Authority and its representatives shall also be permitted to inspect at any reasonable time any part of the Airport Sites or any of the Concession Assets in order to monitor compliance with the Concessionaire's obligations under this Concession Agreement, for which purpose the Concessionaire shall grant such access or procure the grant of such access (including to or from third parties) as they shall reasonably require in connection therewith, provided that such persons shall not interfere with the performance of the Works or give any instruction in relation thereto or interfere with the carrying on of the Airport Services. If any such exercise reveals that the Concessionaire has not complied in any material respect with its obligations under this Concession Agreement, the costs of any such inspection shall be borne by the Concessionaire. The Contracting Authority shall exercise its rights of inspection under this Clause 20.8.2 (Rights of Audit and Inspection) in a manner intended to minimize interference with the Airport Business.

If the Interconnection Customer intends to locate the Large Generating Facility in a Balancing Authority Area other than the Balancing Authority Area within whose electrically metered boundaries the Large Generating Facility is located, and if permitted to do so by the relevant transmission tariffs, all necessary arrangements, including but not limited to those set forth in Article 7 and Article 8 of this LGIA, and remote Balancing Authority Area generator interchange agreements, if applicable, and the appropriate measures under such agreements, shall be executed and implemented prior to the placement of the Large Generating Facility in the other Balancing Authority Area.

The Parties shall inform each other of any change of the structure, organisation and division of competences, including of the contact points, concerning such competent authorities.
