SPECIAL U.S. GOVERNMENT PROVISIONS. If Xxxxx's representative indicates that this Order is placed under a Government Prime Contract or higher-tier subcontract, then the following contract clauses, contained in the Federal Acquisition Regulation (FAR), as amended below, apply. The following definitions shall apply to this Order except as otherwise herein provided:

To the extent that the Federal law of Government Contracts is not determinative recourse shall be had first to the Federal law of sales applying the uniform Commercial Code, and

If this Agreement is placed pursuant to a U.S. Government prime contract with the National Aeronautics Space Administration (NASA) for firm fixed price orders for non-commercial materials and/or services, applicable special provisions are found in Attachment "A-1" and incorporated herein by reference to this Agreement.

Seller hereby agrees to flow down the applicable FAR, DFARS, or other agency clauses to its lower-tier subcontractors as required.
