Special Form Insurance. During the Term Landlord shall maintain special form property insurance on the Premises, excluding coverage of Tenant’s Personal Property located on or in the Building but including the Tenant Improvements, to the extent of at least ninety-five percent (95%) of full replacement value, including inflation endorsement, sprinkler leakage endorsement and, at Landlord’s option, earthquake coverage. Such insurance shall also include insurance against loss of rents on a special form basis, including earthquake, covering at least twelve (12) months commencing on the date of loss. Such insurance shall name Landlord and Landlord’s Agents as named insured and include a lender’s loss payable endorsement in favor of Landlord’s lender (Form 438 BFU Endorsement). Operating Expenses shall include any deductibles payable in connection with Landlord’s insurance. Tenant shall not do or permit anything to be done in or about the Premises which invalidates Landlord’s insurance policies and if Landlord’s premiums are increased due to Tenant, any increase shall be paid by Tenant.

Special Form Insurance. A property insurance policy covering for loss or damage to Tenant’s inventory, merchandise, signs and goods and Tenant’s FF&E and other removable personal property within the Premises, with coverage at least as broad as the standard ISO Form CP 1030, including fire, lightning, windstorm, hail, explosion, riot, strike, civil commotion, aircraft, smoke, vandalism, malicious mischief, sprinkler damage, collapse, water damage, and other perils common to a special form policy, in an amount equal to the full replacement cost thereof, with such deductible amounts as Tenant may elect, subject to Section 7.4 below. Landlord shall have no interest in the insurance maintained by Tenant under this Section 7.1(a)(iii) with respect to Tenant’s Property, and will execute all documents necessary or proper in connection with the settlement of any claim or loss by Tenant to confirm same.

Such insurance must include the State of Florida as an additional insured for the entire length of the resulting contract. All such insurance certificates shall provide that such policies shall not be cancelled without at least ten (10) days prior written notice to each.
