Significant Wetlands and Coastal Wetlands. The western tip of the 1,260 ha Foxboro Swamp PSW has been identified approximately 60 m east of the subject property (Figure 2). Foxboro Swamp PSW is described by Lower Trent (2001) as; An extensive wetland located approximately 2 km north of Foxboro. This wetland is composed of 90% swamp and 10% xxxxx. It is important hydrologically as a groundwater recharge area and plays an important role in flood attenuation. The Foxboro Swamp is connected to the Moira River along the south and to the forests of the Oak Hills to the west. It provides habitat for a number of significant species including norther harrier, black tern, osprey, and otter. This wetland is also important as spawning and rearing areas for several fish species including pike, perch, muskellunge, bass, and pickerel. During the field review completed by Xxxxxx Group on March 14, 2018, a review of potential impacts from the proposed development on the Foxboro Swamp PSW was completed. During this review, the PSW was noted to exist on the east side of County Road 14 (photographs in Appendix B). Additional isolated wetland features were observed adjacent (east and west) to the former County Road 14 roadbed; however, according to MNRF mapping these wetlands have not been included in the PSW. The potential for impacts to the PSW is considered low, as there are three (3) road features (barriers); Xxxxxx Xxxx, xxx xxxxxx Xxxxxx Xxxx 00 roadbed, and the existing County Road 14 roadbed, between the subject property and the PSW. A review was completed along Xxxxxx Road for centreline culverts which may connect the drainage ditch on the west side of Xxxxxx Road with the wetland(s) to the east. No centreline culverts were observed, further affirming limited surface connection to the PSW. In addition, given the location of the PSW in proximity to the subject property, potential for vegetation removal or equipment entry into the feature associated with the proposed development is considered unlikely. As such, limited impacts to the Foxboro Swamp PSW are anticipated as a result of the undertaking. No other PSWs or Significant Coastal Wetlands have been identified on or adjacent to the subject property.

  • Environmental Pollution Unless disposition of environmental pollution is specifically a part of this contract, PURCHASER shall immediately notify STATE of any hazardous substance(s) which PURCHASER discovers or encounters during performance of the operation. "Hazardous substance(s)" are those substances, materials, or wastes regulated by state or federal law. PURCHASER shall immediately cease operating in any particular area of the operations where a hazardous substance(s) has been discovered or encountered, if continued operations in such area would present a bona fide risk or danger to the health or well being of PURCHASER's or any subcontractor's work force. Upon being notified by PURCHASER of the presence of hazardous substance(s) on the areas of operations, STATE shall arrange for the proper disposition of such hazardous substance(s).

  • Wetlands Protection Xxxxxxxx requiring protection under Executive Order 11990 are shown on Sale Area Map. Vehicular or skidding equipment shall not be used in such wetlands, except where roads, landings, and tractor roads are approved under B5.1 or B6.422.   • Environmental Tobacco Smoke Public Law 103-227 (also known as the Pro-Children Act of 1994) and Vermont’s Act 135 (2014) (An act relating to smoking in lodging establishments, hospitals, and child care facilities, and on State lands) restrict the use of tobacco products in certain settings. Party shall ensure that no person is permitted: (i) to use tobacco products or tobacco substitutes as defined in 7 V.S.A. § 1001 on the premises, both indoor and outdoor, of any licensed child care center or afterschool program at any time; (ii) to use tobacco products or tobacco substitutes on the premises, both indoor and in any outdoor area designated for child care, health or day care services, kindergarten, pre-kindergarten, elementary, or secondary education or library services; and (iii) to use tobacco products or tobacco substitutes on the premises of a licensed or registered family child care home while children are present and in care. Party will refrain from promoting the use of tobacco products for all clients and from making tobacco products available to minors. Failure to comply with the provisions of the federal law may result in the imposition of a civil monetary penalty of up to $1,000 for each violation and/or the imposition of an administrative compliance order on the responsible entity. The federal Pro-Children Act of 1994, however, does not apply to portions of facilities used for inpatient drug or alcohol treatment; service providers whose sole source of applicable federal funds is Medicare or Medicaid; or facilities where Women, Infants, & Children (WIC) coupons are redeemed.
