Safeguards for Protection of PHI. (a) Business Associate will use appropriate safeguards to prevent use and/or disclosure of PHI other than as provided for by this Agreement.
Safeguards for Protection of PHI. Business Associate shall develop, implement, maintain and use appropriate administrative, technical and physical safeguards to prevent the use or disclosure of PHI, in any form or media, received from, or created or received by Business Associate on behalf of, the University, other than as provided for by this Agreement. Business Associate shall document and keep such security measures current.
Safeguards for Protection of PHI. Contractor agrees to implement and utilize appropriate safeguards to prevent the use or disclosure of PHI other than as provided by this Agreement or in HIPAA. Contractor specifically agrees to comply with the HIPAA Privacy Rule, the HIPAA Security Rule and the Breach Notification Rule that are directly applicable to Contractor. Contractor agrees to use appropriate safeguards to comply with HIPAA with respect to Electronic PHI to prevent the use or disclosure of Electronic PHI, other than as provided for by HIPAA and this Agreement. Contractor represents and certifies that it has conducted a HIPAA Security Rule risk analysis and has taken appropriate measures to assess and manage security risks. Contractor agrees to take reasonable steps to ensure that the actions or omissions of its Workforce and any agents or subcontractors do not cause Contractor to breach the terms of this Agreement.
Safeguards for Protection of PHI. Business Associate acknowledges that MetroHealth is relying on the security safeguards of Business Associate in selecting Business Associate as a business partner. Therefore, in accordance with applicable state and federal law, including, but not limited to HIPAA and the Regulations, Business Associate shall: Implement and maintain appropriate administrative, physical, and technical safeguards to prevent unauthorized use or disclosure of PHI; and Implement administrative, physical, and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of Electronic PHI that it creates, receives, maintains, or transmits on behalf of MetroHealth as required by the Regulations.

Business Associate agrees to use appropriate safeguards to prevent the use or disclosure of PHI other than as provided for by this Agreement or as required by law, as required by 45 C.F.R. § 164.504(e)(2)(ii)(B). Business Associate agrees to implement administrative, physical, and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of ePHI that it creates, receives, maintains, or transmits on behalf of Covered Entity, as required by the HITECH Act and 45 C.F.R. §§ 164.308, 164.310, 164.312 and 164.316.

Vendor shall use appropriate administrative, technical and physical safeguards, and comply, where applicable, with the Security Rule with respect to any PHI that constitutes Electronic Protected Health Information, to prevent Use or Disclosure of PHI other than as provided for by this Agreement.

Business Associate agrees that in accordance with applicable statutes and regulations, including, but not limited to HIPAA; it (a) will protect and safeguard from any oral and written disclosure all confidential information regardless of the type of media on which it is stored (e.g., paper, fiche, etc.) with which it may come into contact (b) implement and maintain appropriate policies and procedures to protect and safeguard the PHI; and (c) use appropriate safeguards to prevent use or disclosure of PHI other than as permitted by this Attachment or required by law. Business Associate acknowledges that MHS is relying on the security safeguards of Business Associate in selecting Business Associate as a business partner. Business Associate shall promptly notify MHS of any material change to any aspect of its security safeguards.
Safeguards for Protection of PHI. Business Associate agrees to use appropriate safeguards, and comply with Subpart C of 45 CFR Patt 164 with respect to electronic PHI, to prevent use or disclosure of PHI other than as provided for by the Services Agreement and this Agreement.
