Common use of Rights of the Grievant and the Association Clause in Contracts

Rights of the Grievant and the Association. The grievant has the right to Association representation at all hearings involving the grievance. The Association has the exclusive right to be present for the adjustment of any and all grievances. Grievance forms shall be exhibited in the Appendix of this contract and it shall be the exclusive right of the Association to issue forms to the grievant. The Association shall have the exclusive right to determine whether to proceed to the arbitration step of the procedure. The grievant shall identify the following information on the Grievance Form: his/her name; the nature of the alleged violation including all relevant facts; the specific provisions of the Master Agreement allegedly violated; and the specific relief being sought. The Association and grievant shall receive copies of all grievance responses in the processing of a grievance.
