Review and Negotiation. The parties acknowledge that they have each reviewed and participated in drafting the terms and provisions of this Agreement and that this Agreement was and shall be deemed for all purposes to have been drafted by both parties. Furthermore the parties agree that any rule of construction to the effect that ambiguities are to be resolved against the drafting party shall not be employed in the interpretation or construction of this Agreement.

Review and Negotiation. The parties agree the Consultative Committee will review the Agreement every six months, and shall commence negotiations no earlier than six months prior to its expiry date with a view to reaching agreement on the terms of a new Enterprise Agreement.
Review and Negotiation. The LPA reviews qualifications and/or interviews (minimum of 3) consultants based on the information supplied to them to select the best qualified firm for the project. The LPA and Consultant then negotiate the estimate for services. If a consensus cannot be reached, negotiations cease and the next ranked consultant is contacted for negotiations.

  • NEGOTIATION PROCEDURE A. The parties agree to enter into collective negotiations over a successor Agreement in accordance with Chapter 123, Public Laws 1974, in good-faith effort to reach agreement on matters concerning the terms and conditions of employment. Such negotiations shall begin not later than October 1 of the calendar year preceding the calendar year in which this Agreement expires. Any Agreement so negotiated shall apply to all employees, be reduced to writing, adopted and signed by the Board and the Association.

  • Review and Appeal (a) Each Party shall establish or maintain judicial, quasi-judicial, or administrative tribunals or procedures for the purpose of the prompt review and, where warranted, correction of final administrative actions regarding matters covered by this Treaty. Such tribunals shall be impartial and independent of the office or authority entrusted with administrative enforcement and shall not have any substantial interest in the outcome of the matter.

  • Review and Approval Documents specified above must be submitted for review and approval by CITY Purchasing and Contracts prior to the commencement of work by CONTRACTOR. Neither approval by CITY nor failure to disapprove the insurance furnished by CONTRACTOR shall relieve CONTRACTOR of CONTRACTOR’S full responsibility to provide the insurance required by this Contract.
