Common use of Reinstatement after Disability Separation Clause in Contracts

Reinstatement after Disability Separation. An employee given a disability separation shall have the right to reinstatement within two (2) years after having been given a disability separation to a position in the classification the employee held at the time of separation. If the classification the employee held at the time of separation no longer exists or no longer is utilized by the employee’s appointing authority, the employee shall be placed in a similar classification. If no similar classification exist, the employee may be laid off.
