Procedures for Objecting to or Requesting Exclusion From Settlement. A. Objections: Only Settlement Class Members, on their own behalf and not on behalf of any class, may object to the Settlement. Those who wish to object to the Settlement must do so in writing. Written objections must (1) state the basis of the objection and all required information from the Long Form Notice, (2) be mailed to the Settlement Administrator, Class Counsel, and Defendant’s counsel, and (3) be filed with the Court by the Objection/Exclusion Deadline. No Settlement Class Member shall be entitled to be heard at the Final Approval Hearing (whether individually or through separate counsel) or to object to the settlement, and no written objections or briefs submitted by any Settlement Class Member shall be received or considered by the Court, unless written notice of the Settlement Class Member’s intention to appear at the Final Approval Hearing, and copies of any written objections or briefs, have been timely filed with the Court and served on counsel for the Parties and the Settlement Administrator on or before the Objection/Exclusion Deadline.
