Press Releases; Marketing. Microsoft shall include information about this Agreement (except financial terms and conditions), the Company and the Product in futuxx xxxxx xxxeases for any MS Tool Products that include the Product. Financial terms and conditions of this Agreement shall not be disclosed without the mutual written consent of both parties. The Company may issue its own press release announcing the basic terms of this Agreement at the same time that Microsoft issues its first press release concerning the Product. Microsoft and the Company shall consult with one another concerning the form and contents of any press release concerning the Product and the terms of this Agreement prior to the issuance of any such press release. The parties shall undertake reasonable efforts during the term of this Agreement to market and promote the Product and the MS Tool Products.

  • Press Releases The Company agrees that it will not issue press releases or engage in any other publicity, without the Representative’s prior written consent (not to be unreasonably withheld), for a period of twenty-five (25) days after the Closing Date. Notwithstanding the foregoing, in no event shall the Company be prohibited from issuing any press releases or engaging in any other publicity required by law, except that including the name of any Underwriter therein shall require the prior written consent of such Underwriter.
