Common use of Physical/Mental Fitness Clause in Contracts

Physical/Mental Fitness. To the extent permitted by law, the Board reserves the right to suspend, retire or discharge administrators who are not physically or mentally fit to perform their duties in a satisfactory manner. Such action shall only be taken if a physical examination performed by a medical doctor of the Board's choice at the Board's expense reveals such physical or mental unfitness. If the administrator disagrees with such doctor's findings, then the administrator, at his/her own expense, may obtain a physical or mental examination from a medical doctor of his/her choice. Should there be a conflict in the findings of the two (2) doctors, then a third (3rd) doctor mutually satisfactory to the Board and the Association, shall give the administrator a physical or mental examination. The fee charged by the third (3rd) doctor shall be paid by the Board and the doctor's findings shall be binding on the administrator, Board and Association.
