Payment for Unused Vacation Upon Termination. Any employee who is about to terminate his/her employment and who has unused vacation time in either bank shall be paid for such vacation time in his/her final paycheck. As noted above, payment of vacation time in the original bank will be paid (as permitted by Labor Code section 227.3 with an agreement of the parties) at the employee’s base hourly rate of pay as of June 23, 2013. It shall not be necessary to carry such employee on the payroll for the vacation period and the vacancy thus created may be filled at any time after the effective date of termination. When termination is caused by death of the employee, payment shall be made to the employee's designated beneficiary or in accordance with the law.
