Common use of Overtime Pay Clause in Contracts

Overtime Pay. All time worked in excess of the basic workweek, as defined in Sections 5.01 and 5.05 and hours worked in excess of eight (8) hours in a day shall be paid at the rate of time and one-half (1½) the regular rate. All hours worked in excess of ten (10) hours in a day and in excess of 48 hours in a regular workweek shall be paid at twice the regular rate. Compensating time off shall not be given in lieu of overtime pay. Employees shall be paid time and one half the regular rate for all hours worked after their fifth (5th) work day in a week. It is agreed that no one will be paid more than one (1) overtime premium for any overtime hours worked. When required to work overtime, an employee may decline if the employee has a valid reason.
