OTC Bulletin Board Listing. Parent has made all filings required and taken all actions necessary to maintain its listing on the OTCQB.

Subject to the foregoing proviso, if continued listing is not secured by the Closing, the parties shall continue to use their commercially reasonable efforts after the Closing to obtain such listing.
OTC Bulletin Board Listing. The Company agrees and covenants that it will not seek to have the trading of its Common Stock on the Bulletin Board suspended or terminated, will use its best efforts to maintain its eligibility for trading on the Bulletin Board (including, the selection of one or more broker-dealers as "market makers" in the Common Stock on the Bulletin Board, and the provision of all information to such parties as they shall require in order to maintain such eligibility) and, if such trading of its Common Stock is suspended or terminated, will use its best efforts to requalify its Common Stock or otherwise cause such trading to resume.
OTC Bulletin Board Listing. Hyperion shall take all actions reasonably requested by AI in connection with arranging for the Hyperion Common Stock to be listed on the OTC Bulletin Board.
