Non-resident becomes a VILLAGE RESIDENT. The non-resident must follow the standard application procedures for admission to the VILLAGE. The decision whether or not to accept the non-resident shall be made by the VILLAGE, in its sole discretion. If the non-resident is accepted for residency at the VILLAGE, the non-resident and the RESIDENT will be required to sign an amended Unit Residency Agreement and will be charged an additional NON-REFUNDABLE Accommodation Fee equal to twenty-five percent (25%) of the Accommodation Fee applicable to RESIDENT’S Unit at the time of acceptance of the new RESIDENT. The amount of the Accommodation Fee paid by the new RESIDENT is NOT refundable in any part and is NOT added to the Accommodation Fee paid by the RESIDENT for purposes of determining any later refund of the Accommodation Fee. The RESIDENT will by charged the monthly Service Fee for a Unit occupied by two people. Upon termination, the refund of Accommodation Fee due under Article VI, shall be paid solely to the original RESIDENT, or the original RESIDENT’S estate, and to the extent the new resident claims an interest in such Fee, such claim shall be resolved with the RESIDENT, and the VILLAGE shall have no obligation or liability with respect thereto. The refund of the Accommodation Fee will be paid according to the terms of Paragraph VIII.B above.
