Platby In consideration for the services rendered by the Institute, in the Study, the Sponsor agrees to pay to the Institute according to the Budget, attached as Exhibit B hereto (the “Fee”). The Fee shall be payable for each eligible Subject properly enrolled according to the Protocol upon proper completion and delivery to the Sponsor of the Case Report Forms (the “CRF”) for each Subject. The Fees, plus VAT calculated in the legal amount, shall be the full remuneration and payment by Sponsor for all costs incurred in the course of the clinical Study. Any and all taxes or other registration charges shall be borne by the Institute. The Sponsor will not pay Fees, reimburse any expense, charge, cost, nor bear any liability to the Institute, nor to any other person or entity, in respect of any Subject in excess of the maximum number of Subjects specified in the previous sentence. Perusahaan ini membutuhkan lahan tanah yang luas guna usaha perkebunan kelapa sawit. Dari usaha yang dilakukan, akhirnya PT. Era Sakti Wiraforestama mendapatkan lahan tanah yang diinginkannya dengan menggunakan tanah xxxxx masyarakat kecamatan Xxxx Xxxx. Penggunaan tanah masyarakat adat Xxxx Xxxx untuk keperluan usaha perkebunan PT. Era Sakti Wiraforestama bukanlah terjadi dengan sendirinya xxx penguasaan semena-mena, melainkan diawali dengan suatu perjanjian kepada xxxxx masyarakat pemilik tanah tersebut. Perjanjian yang diadakan antara PT. Era Sakti Wiraforestama dengan masyarakat adat Xxxx Xxxx adalah perjanjian penggunaan tanah untuk keperluan usaha, yang dituangkan dalam surat perjanjian. Dalam perjanjian yang diadakan, ditentukan xxx xxx kewajiban masing-masing pihak, umumnya hak dari pihak PT. Era Sakti Wiraforestama dapat menggunakan tanah milik masyrakat adat untuk kegiatan usaha perkebunannya hingga jangka waktu yang ditentukan dengan kewajiban membayar sejumlah harga dari hasil perkebunan yang dilakukan xxx mengembalikan pengelolaan tanah tersebut kepada xxxxx masyarakat adat pada saat berakhirnya jangka waktu perjanjian. Sedangkan hak masyarakat adat selaku pemilik tanah selain mendapatkan bagian hasil perkebunan juga mendapatkan tanahnya kembali setelah berakhirnya perjanjian. Dikarenakan penggunaan tanah untuk usaha perkebunan memakan waktu yang cukup lama, maka banyak terjadi perubahan- perubahan dalam pelaksanaan perjanjian yang kadangkala tidak diketahui oleh pihak xxxxx masyarakat, sehingga merugikan xxxxx masyarakat itu sendiri. Dengan terjadinya perubahan-perubahan dalam pelaksanaan perjanjian tanpa diketahui oleh pihak xxxxx masyarakat adat Xxxx Xxxx, timbulah berbagai permasalahan berupa :
Playground ~ The playground is primarily for the use of children under the age of twelve (12). Any child caught throwing rocks, vandalizing, or hitting or teasing other children will be asked to leave the playground. An adult or appropriate baby-sitter must accompany all children under the age of six (6) years old. Garbage ~ The storage, collection and disposal of refuse and garbage in the recreational camping areas shall be conducted as to create no health hazards, rodent harborage, insect breeding areas, accident or fire hazards, or air pollution. Bag all food garbage in plastic and tie shut before placing in the dumpster, to prevent odor and rodents which are drawn to the garbage area, such as skunks, raccoons etc. Dumpster is for normal daily household garbage, no large boxes, building supplies, carpets etc. Camper is to dispose of this type of garbage elsewhere. Garbage may be placed in dumpsters only. If a dumpster is full, do not place garbage on or around the dumpster, find an empty dumpster to place your garbage into. Bags of garbage may not be set outside your camper for any reason. Disposal or deposit of hazardous or toxic waste is prohibited. No gas, oil, batteries, or car fluids may be deposited into the dumpsters or around the dumpsters. Hazardous materials will not be disposed of by the garbage service. Disposal or deposit of furniture, barbeque grills, washer, dryers, and other large household items are NOT permitted on, in or around the dumpsters. Holding Tanks ~ There is no size restriction on holding tanks, however, they must be opaque XX xxxx/black water approved tanks. The on-site dump station may be used to empty tanks that hold 50 gallons or less. For tanks over 50 gallons Camper must contract with a pumping service to pump and remove tank contents from campground. No dumping of xxxx water onto the ground. Docks ~ Campground does NOT have a lifeguard on duty. The docks are privately owned. In order to be on someone's dock you must receive permission from the dock owner. An adult must accompany all children on the docks after dark. Life jackets are required for young children fishing off docks. Running, diving, and/or horseplay are not allowed on the docks. All debris and toys must be removed from the docks, beach and marina area. Inappropriate behavior, intoxication or shouting on docks is not allowed. Glass is not allowed on the beach area. Jet skies, wave runners, etc. are not permitted in the marina area. Tires cannot be left in the marina area under boats or tied onto docks. Fish House ~ Clean up fish cleaning facility when done with your fish cleaning and bag all fish remains. Fish cleaning house must be kept clean and all fish waste must be put into plastic bags and deposited into dumpster and cover on dumpster closed. No dumping of fish wastes into marina or dog waste stations! Swimming Pool ~ Campers are required to abide by all rules posted in and around the pool area.
Záznamy The Institution and the Investigator shall maintain accurate, complete and current records of all Study Data, including the Case Report Forms (or equivalent electronic data), relevant source documents and any other essential documents or materials as required by the Protocol, the Applicable Regulatory Requirements and PSI’s and the Sponsor’s instructions (collectively the "Records"). The Institution and the Investigator shall keep all the Records in a safe and secure location for the period required by the Applicable Regulatory Requirements, or for a period of fifteen (15) years following the completion of the Study, whichever is longer. The Institution and/or the Investigator may destroy the Records at the end of the Records keeping period on the condition that the Institution and/or the Investigator sends written notice to the Sponsor at least sixty (60) days prior to the date deletion/disposal will occur, and, if requested by the Sponsor, cooperates with the Sponsor in extending the Record keeping period or shipping the Records to another facility for storage, at the Sponsor’s reasonable expense. Zdravotnické zařízení a Hlavní zkoušející povedou přesné, úplné a aktuální záznamy o všech Studijních údajích, které budou zahrnovat Záznamy subjektů hodnocení (nebo odpovídající údaje v elektronické podobě), příslušné zdrojové dokumenty a jakékoli další nezbytné dokumenty nebo materiály dle požadavků Protokolu, Platných regulačních požadavků a pokynů PSI a Zadavatele (dále jen „Záznamy“). Zdravotnické zařízení a Hlavní zkoušející budou Záznamy uchovávat na bezpečném a zabezpečením místě xx xxxx xxxxxxxxxxx Xxxxxxxx regulačními požadavky nebo po dobu patnácti (15) let od dokončení Studie (kterákoli doba bude delší). Zdravotnické zařízení a/nebo Hlavní zkoušející mohou Záznamy po uplynutí lhůty pro uchovávání Záznamů zlikvidovat za podmínky, že Zdravotnické zařízení a/nebo Hlavní zkoušející zašlou Zadavateli oznámení alespoň šedesát (60) dnů před datem vymazání/likvidace Záznamů a na žádost Zadavatele s ním budou spolupracovat na prodloužení lhůty pro uchovávání Záznamů nebo zaslání Záznamů do jiného zařízení, kde budou uloženy, a to na přiměřené náklady Zadavatele.
Anwendbares Recht und Teilnichtigkeit Dieser Lizenzvertrag unterliegt den Gesetzen des Staates Kalifornien, ausgenommen den Bestimmungen zur Gesetzeskollision, und ist gemäß diesen auszulegen. Dieser Lizenzvertrag unterliegt nicht der United Nations Convention on Contracts for the International Sale of Goods, deren Anwendung hiermit ausdrücklich ausgeschlossen wird. Wenn Sie Verbraucher mit Wohnsitz in Großbritannien sind, unterliegt dieser Lizenzvertrag den Gesetzen Ihres Wohnorts. Vlastnictví Zdravotnické zařízení si ponechá a bude uchovávat Zdravotní záznamy. Zdravotnické zařízení a Zkoušející převedou na Zadavatele veškerá svá práva, nároky a tituly, včetně práv duševního vlastnictví k Důvěrným informacím (ve smyslu níže uvedeném) a k jakýmkoli jiným Studijním datům a údajům.
