Method of Classifying. The Contractor may use any method he chooses to excavate any class of material, but his chosen method of excavation shall not determine the classification of the excavation. The Engineer will decide on the classification of the materials excavated. The classification will be based on inspection of the material to be excavated and on the criteria given in 3.1.2 (a) to (e), as applicable. All equipment specified in 3.1.2 (a) to (c) shall be in good mechanical condition. "Efficiently", as used in 3.1.2 (a) to (c) shall be deemed to mean, "in a manner that can reasonably be expected of a contractor, having regard to the production achieved". In the event of a disagreement between the Contractor and the Engineer, it shall be the responsibility of the Contractor, if so required and subject to the terms of subclause 4.1 of SABS 1200D-1988, to make available at his own expense such mechanical equipment as is specified in 3.1.2 (a) to (c), in order to assess the reasonable removeability, or otherwise, of the material.The Engineer's decision on the classification shall then, subject to the relevant provisions of the Contract, be binding.

  • Method of Billing Consultant may submit invoices to the City for approval on a progress basis, but no more often than two times a month. Said invoice shall be based on the total of all Consultant’s services which have been completed to City’s sole satisfaction. City shall pay Consultant’s invoice within forty-five (45) days from the date City receives said invoice. Each invoice shall describe in detail, the services performed, the date of performance, and the associated time for completion.
