Common use of Licensing & Qualifications Clause in Contracts

Licensing & Qualifications. All employees are required to maintain the appropriate licenses, certificates, and/or accreditations for the performance of their job responsibilities. The Employer agrees to post or otherwise notify employees of the expiration dates the Employer has on file for required licenses, certificates, and/or accreditations not less than every six (6) months. Failure to maintain such licenses, certificates and/or accreditations may result in corrective action, up to and including discharge. It is the responsibility of each individual employee to ensure that all licenses, certificates, and/or accreditations are maintained. Employees who perform work duties without the required license, certificate, and/or accreditation may be subject to discharge. Employees who notify the Employer prior to the expiration or loss of a required license, certificate, and/or accreditation shall be given thirty (30) days to obtain a current and valid license, certificate, and/or accreditation. Employees whose required license, certificate, and/or accreditation expires shall be placed on unpaid administrative leave and receive a final written warning. Failure to obtain the required license, certificate, and/or accreditation within thirty (30) days shall be cause for separation from employment. Employees whose state or local license is temporarily suspended by a state or local agency (other than suspensions covered by Article 26 of this Agreement) shall be placed on unpaid administrative leave for a maximum of ninety (90) days. Employees may utilize accrued PTO solely at their option during any portion of the suspension. Employees shall be required to have all licenses, certifications, and/or accreditations up to date at the conclusion of the suspension. Failure to maintain such licenses, certifications, and/or accreditations shall be cause for separation from employment. Employees on approved leaves of absence shall be required to have all licenses, certifications, and/or accreditations up to date prior to returning from leave except as otherwise provided in Article 13.2 of this Agreement. Failure to maintain such licenses, certifications, and/or accreditations shall be cause for separation from employment.

Should the Employer, State, Federal or County require continuing education or specific testing/training courses/classes, the Employer will provide such testing/training and will pay the employee for time spent at the appropriate rate of pay for required hours to attend such testing/training or courses/classes each year.

In the event the employee does not less than every six provide updated licensure or certification within the fourteen (614) monthscalendar days the employee will be terminated. It In reference to the LADOT, it is the sole responsibility of each individual the Employer to set up appointments within the appropriate time that is required. This requirement is subject to change depending on Agency process changes. In the event the appointment assigned by LADOT falls on the employee’s scheduled shift, all efforts will be made to accommodate their appointment. An employee to ensure that all licenses, certificates, and/or accreditations are maintained. Employees who perform work duties without the required license, certificate, and/or accreditation may whose LADOT permit has expired will not be subject to discharge. Employees who notify the Employer prior above-mentioned suspension, unless they have missed 3 or more appointments due to the expiration or loss employee cancelling the appointment. If an employee changes their schedule after being notified of an appointment and that change conflicts with the appointment, the schedule change will be deemed a required license, certificate, and/or accreditation shall be given thirty (30) days to obtain a current and valid license, certificate, and/or accreditation. Employees whose required license, certificate, and/or accreditation expires shall be placed on unpaid administrative leave and receive a final written warning. Failure to obtain the required license, certificate, and/or accreditation within thirty (30) days shall be cause for separation from employment. Employees whose state or local license is temporarily suspended by a state or local agency (other than suspensions covered by Article 26 of this Agreement) shall be placed on unpaid administrative leave for a maximum of ninety (90) days.
