Installation of Equipment. You represent that there are no legal, contractual or similar restrictions on the installation of the ViaSat Equipment in the location(s) you have authorized. It is your responsibility to ensure compliance with all applicable building codes, zoning ordinances, homeowners’ association rules, covenants, conditions, and restrictions related to the Services, to pay any fees or other charges, and to obtain any permits or authorizations necessary for the Services (collectively "Legal Requirements"). You are solely responsible for any fines or similar charges for violation of any applicable Legal Requirements. You acknowledge and agree that ViaSat or our designated service provider will be required to access your premises and system to install and maintain the ViaSat Equipment, including the antenna and its components, necessary for you to receive the Service inside and outside your home. This will include attaching a satellite modem to your computer, installing software on your computer and configuring your computer for optimized performance of the Service. By signing this Agreement, scheduling a service or installation visit, and permitting us or our service provider to enter your home, you are authorizing ViaSat and our service provider to perform all of the above actions. NEITHER VIASAT NOR RIO GRANDE ELECTRIC COOPERATIVE/RIONET SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM INSTALLATION, REPAIR OR OTHER SERVICES, INCLUDING WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES, OR LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER. You are responsible for backing up the data on your computer and we highly recommend that you do so prior to permitting access to us. This limitation does not apply to any damages arising from the gross negligence or willful misconduct of any installation or maintenance service provider. NEITHER VIASAT NOR RIO GRANDE ELECTRIC COOPERATIVE/RIONET SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM INSTALLATION, REPAIR OR OTHER SERVICES, INCLUDING WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES, OR LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER. NEITHER VIASAT NOR ITS SERVICE PROVIDER SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM THE EQUIPMENT OR ANY INSTALLATION, REPAIR OR OTHER SERVICES ASSOCIATED WITH THE EQUIPMENT, INCLUDING, WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES OR LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER. This limitation does not apply to any damages arising from the gross negligence or willful misconduct of any installation us or maintenance one of our designated service providerproviders. Timeframes Time frames for installation, if any, are not guaranteed and may vary depending on the types of services requested, weather conditions, requested and other factors. If we determine in our sole discretion that there are unacceptable hazards associated with the installation, we may discontinue the installation at any point and terminate this Agreement without liability. In such a case, you will not incur a Termination Fee.

You represent that there are The Subscriber shall allow Zinia or its approved representative to carry out such work at the Subscriber’s premises as is necessary to effect installation and/or implementation and provision of the Services. The Subscriber hereby indemnifies Zinia, its directors, employees, agents or approved representatives against any all loss, damages, costs and expenses, which may be incurred as a result of performing such installation and/or implementation. Zinia shall not in any matter whatsoever be liable for the acts or omissions of whatsoever nature of its approved representatives/agents and or any other party. Nothing in this Agreement confers, or shall be deemed to confer, on the Subscriber any rights in, or license to use, any intellectual property of Zinia. The Subscriber shall make no legalcopies of manuals, contractual documentation, computer programs or similar restrictions intellectual property without the prior written consent of Zinia, nor will the Subscriber use or display the Zinia brand or logo on any document or equipment without Zinia’s prior written consent. The Subscriber hereby expressly acknowledges that installation timeframes provided by ZInia are guidelines only and cannot be guaranteed as various elements of the installation and/or implementation process are dependent on third party service providers and government departments. Accordingly, the Subscriber acknowledges and agrees that it shall not be entitled to cancel this Agreement as a result of any delay in installation and/or implementation, save in circumstances where installation and/or implementation will not be effected within the foreseeable future.
