Influencing Factors. The ability for Helicopter operators to vary operations to reduce impact on surrounding communities is influenced by a number of factors: • The nature of the operation • The terrain over which the operation is conducted • Weather conditions • The type of Helicopter being used • Airspace limitations and mandatory operational and safety requirements • During ATC operating hours, ATC direction overrides the requirements of this agreement. Opportunities to vary operations to reduce disturbance may be identified in: • The altitude of operations over sensitive areas • Flight tracks used including avoidance of sensitive areas and the repetitive use of certain tracks • The origins and destinations of operations • The times of operations • Operating procedures available to the type of Helicopter in use and the type of Helicopter used in some cases.

  • Mitigating Factors The Contractor had a Trafficking in Persons compliance plan or an awareness program at the time of the violation, was in compliance with the plan, and has taken appropriate remedial actions for the violation, that may include reparation to victims for such violations.

  • Aggravating and Mitigating Factors The penalties in this matter were determined in consideration of all relevant circumstances, including statutory factors as described in CARB’s Enforcement Policy.   • Other Factors The Employer may provide for additional formal and informal evaluations as it shall determine to be necessary for the proper conduct of the educational program and the utilization of its employees.
