In-Term Bargaining on No Child Left Behind Requirements (. “NCLB”) No action shall be taken without the agreement of the WREA in regard to any issue relating to the Board’s compliance with the Elementary and Secondary Education Act of 1965, as amended, 20 U.S.C. 6031 et. seq. (2002), where said action would adversely impact any bargaining unit member or otherwise affect the wages, hours or terms and conditions of employment of any bargaining unit member. The Board and the WREA agree that in-term bargaining under this Section shall only be undertaken in the utmost good faith and where the ESEA compliance issue cannot be addressed through methods which do not adversely impact the Collective Bargaining Agreement.
