Hireback Clause Samples
A Hireback clause allows a seller to temporarily lease back an asset, such as property or equipment, from the buyer after the sale is completed. In practice, this means that the seller continues to use the asset for a specified period, often paying rent or a usage fee, while the buyer retains ownership. This arrangement is commonly used in real estate or business asset transactions to provide the seller with additional time to relocate or transition operations. The core function of a Hireback clause is to facilitate a smoother transfer of ownership while minimizing disruption for the seller, addressing logistical challenges that may arise immediately after a sale.
Hireback. (a) Excluding an emergency situation, or operational necessity as determined in the sole discretion of the Sheriff, or his designee, no deputy will be authorized to work more than (4.25) hours in addition to their normal shift. [No double shifts]
(1) Authorization or requirement for any deputy to work more than (4.25) hours in addition to their normal shift must come from the Undersheriff, Sheriff, or their designee. Due to the unpredictable hours of law enforcement, the Sheriff may extend the 4.25 maximum holdover to complete an investigation, report or duty assignment that arises during the holdover.
Hireback. (A) The hireback needs shall be determined by the Chief of Police or his designee, at least one (1) week in advance of the scheduled event. The hireback will be published on a Department Notice and posted on the various bulletin boards throughout the Department, including the union bulletin board.
(B) Officers desiring to work hireback, which shall be voluntary, shall sign their name legibly in the hireback logbook maintained in the supervisor’s office of the Operations Division. Forty-eight (48) hours prior to the scheduled hireback, the duty commander will review the logbook and determine by seniority those eligible for hireback. He shall notify those officers in writing or verbally of their selection. The duty commander will note in the logbook the selection and date of notification(s).
(C) In the event a senior ranking officer is not available to be hired back, when needed, a sergeant may be hired back to fill that vacancy, by seniority as determined by Civil Service date of rank.
(D) In the event an officer scheduled for hireback is unable to appear, he shall notify the duty commander prior to the scheduled time of hireback. The duty commander may poll the on-duty officers on the watch to determine if any of those officers desire to work hireback to fill that vacancy, and if so, the selection shall be made by seniority. In the event an officer is scheduled to work hireback and he is delayed on a late call from his regular duty tour, the hireback shall commence as scheduled. Officers who are scheduled to work hireback, but who fail to appear and fail to provide notification on two (2) occasions within a three (3) month period shall be denied hireback for a period of three (3) months from the last non-appearance occasion.
(E) Any special hireback needs, such as stake-outs, parades, etc., shall be so identified on the bulletin board postings. On a detail hireback, when five (5) or more patrol officers are hired back, at least one (1) sergeant shall be hired back for supervision purposes. ▇▇▇▇▇▇▇▇ shall first be offered to the most senior sergeants on the basis of time in grade. A detail hireback is defined as a hireback assignment in which patrol officers are needed to perform duties related to a specific task as a group; i.e., election commission hireback, and First Night Springfield.
(F) Records of hireback hours shall be kept current and be returned to the officers within five (5) working days.

Hireback. Hireback shall be rotated by the Chief of the Department in accordance with the procedures mutually established by the Department and the Union. The Department shall maintain one hireback list. The rate of pay for all Employees working hireback shall be one and one-half (1½) times the Employee's regular rate of pay. Each shift shall be manned by assigning at least forty-nine (49) Employees per shift. The City shall maintain a minimum complement of forty-five (45) Driver Engineers unless layoffs have occurred. Hireback shall also include hiring of personnel for specific duty assignments, such as training, inspections or other authorized assignments as approved by the Chief of the Department. Payment for hireback will be issued on the same day as the regular pay day. 5.7 Rules Governing Adjustments to ▇▇▇▇▇ Days Following Involuntary Reassignment:

Hireback. Sergeants will be offered overtime for shift supervisor duties prior to it being offered to an OIC for overtime. If patrol officer staffing levels are not met due to the use of an O.I.C, a Sergeant will be hired back to cover supervisory duties. The Chief of Police may order a Sergeant to work a supervisor shift if the shift is not filled. The ordered Sergeant will be the least senior Sergeant in rank available.
Hireback. The Hireback Policy, section A 11 and 12 of the Turlock Fire Department Policies and Procedures, is incorporated into this Memorandum of Understanding and is subject to meet and confer.
